CBS/Paramount sues to stop Axanar

The sad thing is that at this point it seems a general consensus that the majority of the crew who worked to make Prelude the success it is have since jumped ship.

So really while Alec is happy turning up at events, showing it off and collecting awards, those that I can't help feel actually earned them (such as Christian Gossett) won't get the recognition due, and are probably scrubbing what was a good piece of work from their CVs.

It's telling that it's still Prelude that gets shown off all the time. Not the Vulcan scene or that new trailer they had a month or so ago. It's all about Prelude.
 
Might anyone know a (criminal) psychologist?? I'm sure Lord Alec would make a fascinating case study.......

From what I read, Facebook just provides the event space in return for a sponsorship credit or something along those lines - they weren't actually involved with any of that.
 
I'm not a lawyer and I'm damn sure not a judge, but as someone who's covered a lot of trials (civil and criminal) as a reporter I really get the feeling that Klausner is going to nuke LFIM back to the Stone Age. I could be wrong, so don't bet on it, but I just think that C/P strategy is the correct one. I doubt this case goes to trial and ends with a summary judgement.

I wouldn't think so. That kind of surprise is exactly what discovery is supposed to prevent, with the idea of making settlements more likely than a costly trial.

They are crashing a development and sustainability conference, apparently because they have a track about the future of media. Looking at their agenda, I could certainly imagine a lot of their attendees asking WTF about a fan film being stretched into 'the future of media', especially if they knew Axanar was being sued. Does not look like a typical arts oriented context where everyone wants an award. Some of these attendees may actually be offended by being used for PR, if that's how its spun.

I wonder, did Alec get overenthusiastic and share his vision of building a studio and new media distribution network for unlicensed fan films? That would be something...

Axanar is COMPLETELY missing the mark to think this is a "Silicon Valley" event. These are largely career social activists. He'd better have intellectually sound justifications and not just pretense for being there. And an utterly thorough scrubbing of conference attendee knowledge of his for profit studio built from donors. If there's one thing people who build their legit careers around donors are sensitive to, its misusing donor funds. Falsely claiming to be nonprofit would get their rapt attention, too.

This has got to be the stupidest move yet, after countersuing. Let THIS group's awards committee get written up as screening a major crowdsourced donor ripoff, and they will aim all their critical faculties at the interloper.

Mr. Hinman, please take note.

Also, this conference and this panel Alec went to is heavily attended by Indian stars, producers, etc.
Prelude may get a bunch of hits on youtube out of it, but at the same time, the Indian press is not known for, shall we say, restraint in the face of scandal. If these public figures feel they have been punked, there will be press. IMHO.

There might be want-to-be studio owners in India (as well as in any major entertainment market) who would like to emulate the Axanar formula. If this gets any coverage in India, it might seed an Axanar Antibody effect in the Indian entertainment industry. All the 'visionary' accolades will dissolve when the venality is spelled out.

There's not much evidence necessary beyond what is already public. I think @MikeH92467 is spot-on. For all the hand-wringing about this lawsuit, this comes down to three simple questions:

1. Does the plaintiff have a valid copyright?
2. Did the defendant copy from the plaintiff's copyrighted work?
3. Was the defendant's copying fair use?

As I've said before, the presence of Soval in "Prelude" alone would require answering all three of these questions in favor of C/P. Obviously there is substantially more infringement than a single character, but you get the point. As a matter of law, I don't see how the facts could support any other conclusion than a judgment for the studios.

Guess it will depend then on how much they want to pile on, as tempered by how much they want to keep from looking like the bully. Cite the things which look most egregiously criminal, but be concise.

If the judge does issue a summary judgement there will not be any question of piling on. The Judge will do the hammer dropping when/if.

Now I have no idea of the context of the conversations going on here but from the outside it sure does look like Alec has gatecrashed a panel of Bollywood stars. Maybe he's planning on having the Ares crew perform some Hindi dance moves to a Bhangra beat.

Actually, having seen a few Bollywood movies I think that would be a frakking brilliant idea. Bollywood Star Trek? Why has no-one done that yet? Shut up and take my money, Alec!
