Because the Judge needs a witness (IE the Process Server who delivered notification) to be able to come to court, and under oath state: "Yes, I properly served the Defendant with legal notification of the lawsuit." Why? Because otherwise the Defendant can say, "Hey, I didn't know about it."


It is standardized. Notification must be served IN PERSON to the Defendant named in the lawsuit <--- That's the legal standard.
To add .... in a number of states (but I don't believe all of them), you need to be licensed to serve process. So there's a regulatory end to it and, let's not kid ourselves, it's a little $$ to the state.
 
Would the legal notification need to be in a human being's possession the whole time? Could they just mail or email it to a law firm or whatever in California and have one of their people give to him? Or would someone from AP's lawyer's firm need to fly out with it in the possession and hand it to RMB themselves?

No. They don;'t make it this easy for a reason (because there are enough frivolous lawsuits on court dockets.) A defendant must be handed the documents and be given notice of the suit in person by a law enforcement officer, or a licensed process server. Via e-mail or registered main isn't enough.

Mr. peter's lawyer could send the notarized documents to such a process server in the area RMB is living and have them do it <--- But that costs more money; and since the case was filed in a state where the defendant doesn't reside and the alleged loans, etc all occurred while Mr. Peters was himself in California, and thus all transactions would be under California law and jurisdiction; there's a question of whether the suit was filed in ten proper venue to begin with (IE Peters would have to file the suit in a California court as that was where he and Axanar Productions Offices were at the time of these transactions. There was no 'Axanar Productions' corporate entity in Georgia at the time.)

I can understand people shitting on axanar for whatever reasons, thats their choice.

But a lot of the people doing so get very offended when people laugh at fan productions in general. Its like double standard or some personal vendetta.

I enjoyed the first axanar preview clip, and disappointed all that happened since, wherever we think the blame lies, as I was genuinely interested in seeing what promised to be good.
As for those who contributed to axanar, they did so by choice, no one put a gun to their head and were I one of those i would have just cut my losses and moved on.
That's honestly the attitude that would be appropriate to take with many fan productions. For many of these projects, they are on a fine line of being successful or abandoned. I enjoyed the first Axanar preview and really looking forward to seeing more of the era that I enjoy again. But, none of the supporters deserve the firestorm that has occurred.
 
None of the supporters deserved to have their money spent on Peters' Folly, aka The Warehouse That Was Never a Studio. Not to mention tires and sushi.
 
It would be one thing if it were only the first contributors having to cut their losses. He keeps asking for money, and not only are some of the originals giving him more money, but he's managed to hook new people into supporting him. It's not just a "cut your losses" thing when the guy who caused those losses keeps causing new ones.

I understand, but my point is if these people are stupid enough to keep contributing, them there will always be people who will take advantage of that.
Five years in: AP has been sued (and settled, something he swore he'd never do), is working toward his third failed "studio," has wasted million$$ in donation$$, and there are some still waiting patiently for him to ship their patches! Unbelievable!

Yes, there will always be those willing to give, and His Majesty will always be willing to take advantage.

I'll be over here pointing and laughing, and enjoying my pie. :techman:

I find it amazing people will give, give, give to a "production" which produces nothing, has been shown to spend $$ on anything but said production (in all fairness, yes, they paid for Prelude and the Vulcan scene. After that, nada), but won't pay for things like, oh I dunno, universal healthcare? I don't want to specifically get political, it's more that anything with the government is supposed to have some degree of oversight. And even if the oversight is falling down on the job these days, it's still supposed to be there.

But there's no oversight here. There is no transparency. And this is from someone proven to sit on his hands and do nothing -- for YEARS. No one has to believe me, or even the motion exhibits. They can believe the reality of seeing nothing for years. Where's the movie, Alec?

There's no movie. There is no pony there, among the shit.

This is a black hole, people. And you are throwing your retirement funds, your children's inheritance, and your mortgage money down this bottomless well.

I truly hope none of these folks ends up with massive medical bills, but that happens in the US. Because, heh, my taxes will be going to their care, way earlier than they should, because they spent their $$ on beer and hookers Peters and the vaporware that is Axanar.

Yeah, he just wants to be free to do whatever he wants with the money, without having to worry about people finding out what the money is really going towards. Especially since the money won't be going towards making the Axanar shorts.
I wonder what Disney/Marvel would think of him having Captain America's shields on the wall behind him during these live streams?
 
Long before I ever heard of Peters you would see these film projects that would do a reverse merger into some shell pink sheet stock. For just 5 shares for a penny you too could own a piece of the next Lions gate.
The trick is, never lie or the sec will put you behind bars in a heart beat. Besides a film project never makes money until that day it smashes all the box office records... haha
you have 100 billion shares in the treasury and about every other week you're putting out a news release. We just signed this or that actor (who hasn't worked for 10 years) signed a deal with this sound company or that vfx artist and if you do it right, release a few film clips you got a good year and a half of selling a few million shares at a dine every other week before you announce that you didn't make it into Cairns film festival and the stock has been bought out by a laundromat.
Films are like Gold Fever. Peters probably left 6-7 million on the table because he thinks too small.

Thanks for these answers and others who did too. My next question would be this. If Peters filed his lawsuit, then hasn't yet had it served on RMB, how long can he wait before it has to be served. I can't see courts being pleased with Peters if he's trying to bluff RMB into signing a proposed 'settlement'. Surely courts are busy enough as it is.

Very few get made. I think Earthworks entertainment has been playing that game for decades under one name or another.
You don't plant your flag in somebody else's IP and begin building what could be seen as an ongoing profit center.
In other words Peters was raising money by claiming he was going to make the best Star Trek ever. That puts him under the guidance of CBS/Paramount. I wouldn't doubt that to Peters' mind, he was only doing what those before him have already done. Debatable, I'm sure.
You can make whatever space adventure you want, make millions in profits off of it, just don't directly steal other peoples stuff.
 
I'm still not sure why they never "did a Renegades" and filed off the Trek infringement. Does it matter if the principal character is Captain Kirk's hero Garth of Izar, or Captain Kurt's hero Garth of Lizor? It's a shame it never came up as a question in one of RMB's Youtube vids about Axanar, because it has to have been discussed.

Because they could have made the film exactly as originally scripted, and owned everything. Made all the coffee they wanted. Actually legally licensed books. Marketed it to Netflix.

In fact, they still can. But they don't. It makes no sense.
