Car insurance problem

I think you're needless screwing yourself over if you don't get the entire thing dismissed.

You shouldn't have to pay one red cent.

Of course the prosecutor wants to "get this resolved quickly", she has no case as long as you have an insurance card showing the policy was in effect at the time of the ticket.

In court, THEY have to prove THEIR case. They can't prove that you weren't insured, but you can prove that you were.

Like I said, all I have is the card. The actual "proof of coverage" document shows that it was not covered at the time. If the court will not accept the card, then we're screwed and my wife will be suspended.

It's easy to say we should fight it, but if she fights it, we really don't have a good case. All the court needs to convict is a preponderance of evidence since this is an infraction and not a criminal offense.

Technically, the car was not covered, even though the card implies that it was. If the court would not accept that, we're screwed, and it's really up to the judge.

I'll take the sure thing over risking my wife's license on this. It sucks paying the fine, but she cannot be without a license. I live 700 miles away, she'd be pretty fucked if she was unable to drive.

But it's not like this is a criminal trial. Traffic court judges are usually receptive to earnest and honest stories. If you argue that you're the unfortunate victim of an insurance company SNAFU, the fact that you at LEAST have the card with a compelling date on it should be enough for the judge to go light on you.

So, yeah, if it were me, I would fight it. I understand why you choose not to.

If it was me in this situation, yeah, I would most likely fight it. Even if I lost, I could do without a car for a few months. But I don't think it's my place to play with my wife's driving privileges, you know? She doesn't want to fight it--she wants to get it over with.

I'm just glad there was an easy "out" here, even if it costs money. I realize that's exactly the scam prosecutors are always playing in these cases, but what can ya do? :lol:
