The only real argument anyone can advance for "punishment" in this case is restitution - this stunt cost taxpayers some money; the couple should be responsible for that. Celebrating jail time handed down is, first and most of all, celebrating additional incurred cost to the taxpayers. The only reason for considering it a victory is spite - when people start muttering about "deterrence" in cases like this (in fact, in most cases) they're just admitting that they've got nuthin' but an emotional attachment to the case.

What's "pathetic" is that the guy is so smug with his head so far-up his ass that I didn't buy it as anything more than a show to try and gain sympathy from the court of a lighter sentence.
So he's going to serve a few days (couple weeks?) in jail and then go on work release, and also have the CS to do, is the wife going to actualy spend her time in jail or is she going on work-release too? Or did she only spend the time in jail "on paper" and won't go in at all?
With any effort of searching, people can find that the Judge didn't want both parents in jail at the same time.Richard Heene was sentenced to 90 days in jail, including 60 days of work release. Mayumi Heene must serve 20 days in jail after her husband's term ends.
