I find it amazing that Axanar has any leg to stand on. While copyright infringement may be overlooked for fan fiction and things people put together in their basement, any production large enough to employ lawyers is clearly not in that category.
 
What is and is not property, and the rights that embody ownership are simply not absolute and certainly not unchanging. Until the modern era of Big Culture, copyrights lasted 50 years or less. The concept of 'franchise copyright' which the CBS claim hinges on, is an expansion of the traditional rights under copyright which was developed by the courts after WWII.

Axanar will probably lose, but I wouldn't bet my life on them losing on every point or every count.
