After kirk got demoted Spock And scotty technically outranked him

Why wouldn't Kirk get back his seniority based on his prior years as a Captain? I could see it if he was demoted to Commnader and then promoted back to captain.

Well, if you watched the earlier films, I think this was mentioned in TMP, that McCoy told Kirk Captain was more his rank then Admiral. Don't you remember him desperately trying to get the Enterprise back from Decker? I think he never went back to Admiral because Captain suited him more. This was also confirmed in Generations when he told Picard to never let them promote him or remove him from that chair because that's where he can make a difference.
 
"Captain" was his position in ST:TMP (the captain of the vessel). He was still an admiral by rank, right up until he was demoted in ST4:TVH.
 
Except that he was wearing the rank insignia of a captain following the Rec Deck briefing. Similarly, just because you call the commanding officer of a submarine "Captain" doesn't mean he should go pin silver eagles to his collar when he's really just a Commander by rank.

Kirk either requested to be returned to the rank of Captain, or it was the "price" Nogura exacted from him in exchange for letting Kirk take command of the Enterprise again.
 
Maybe he put on captain's bars because he just wanted to, and nobody on the ship was interested in calling him on it. The guy's not big on following the regs.

I'd think Decker would have raised a ruckus at least if what Kirk did wasn't kosher. He had to give up his Captain braid and wear Commander instead, after all.

Hey, perhaps the semi-functional ship wasn't up to creating new uniforms, so Kirk had to confiscate Decker's when changing from his original dress uniform, forcing Decker in turn to borrow from Commander Sonak's closet? (Too bad that the heroes keep on changing clothes like so many little princessas, forcing us to apply this "logic" on the short-sleeved variants as well.)

When Kirk was demoted back down to Captain, do you think he retained his benefits or did he lose two weeks vacation?

"And we'll need the key to the Admiral's washroom back."

It would be great if the Enterprise actually had an Admiral's washroom, and they locked Kirk out after his demotion.
