Girl Dies on Cold Walk; Dad Charged With Murder

Wow... ummmm.... damn.

If they had access to cell phones and someone else who could pick the kids up, why the fuck would he tell his little kids to go walking such a distance in the snow?

That being said, what exactly would be the good of sending this man to jail? Punishment? Well, his kids are dead and he knows it's his fault. He's getting punished already. Deterrent? Well, what exactly would anyone be afraid that he'd do now?
 
Wow. Holy Error in Judgment. Truck is stuck... Step 1 -- Keep kids in truck while assessing the situation. Step 2 -- Call ex-wife and ask for help, since you have her kids in your truck. Step 3 -- Continue working to free the vehicle. Step 4 -- When ex-wife arrives, and you cannot loose the vehicle, call a tow truck.

Jeez, this ain't rocket science.
 
I suggest they take him to a lake that is frozen over, drill a hole and drop him in, then either wait for it to freeze back over or cover it over and let him freeze to death.

Just the daughter died. Son is still alive. And probably also feeling a lot of guilt over letting his little sister turn back without him. Poor family.
 
If they HAD to charge him with something you'd think it would be more like criminal negligence or perhaps even manslaughter. Murder is usually tied to the concept of premeditation.
 
^By my understanding, second degree murder doesn't require premeditation towards murder perse. It's basically saying there was malicious intent behind the death, but a fatality wasn't the intended goal. Only with first degree murder is there a genuine, malicious intent to kill.

With that being said, based on the news report, I don't think this guy's intent was malicious. The man is just stupid beyond any sort of belief. How the hell could you send out an 11-year-old to walk 10 miles in freezing temperatures and not expect something horrible to come out of it? hmm. Actually, now that I think about it, I have a hard time thinking one COULD do that unless one is profoundly retarded. Which might be why he was slapped with a second degree murder charge.

Agreed. He did not intend any harm. He just made an incredibly stupid decision.
 
A murder charge is trumped up, even a Second Degree one.

But the father is a complete and total moron. Sending kids off in 20-degree weather and snow to walk miles to their mother's house?

So sad. But I have to agree 2nd degree mudrer fits. It more or less is meant to be
for "exterme stupidity that leads to a death" sort of like drinking a ton and then driving and hitting someone.

Harsh as it seems, and yes, he is probably suffering, but he did send this poor child to her death even if that was not his intent.

Or 5 - if you do decide to walk, at least don't let your children alone!
 
I can maybe, maybe, in some stupid way, see why he sent his kids off walking. But what I don't get is, once he freed the car, why the hell did he not drive along the road looking for them, to drive them the rest of the way or even just see if they were alright? Instead he turned around and went home. That's disgusting.
 
This is quite tragic, and there is more to the story, methinks.

But I say save the jails for people who are bad, who intend to harm others, not those who make severely bad lapses of judgment from time to time.
 
Even if it was a bright sunny day, it would still be stupid for him to send his kids out alone to walk the 10 miles. But with the weather like it was, he was beyond stupid. I can't believe any adult could be so dumb.

While Second Degree Murder seems a bit harsh, he definitely deserves jailtime for this.

His negligence resulted in her death. This is no different from leaving an infant in a hot or cold vehicle-- and parents have absolutely been charged with murder for less.

What the hell was he thinking. This is 100% his fault.
 
As I've always understood it, Second Degree murder is "murder in the heat of passion" -as opposed to First Degree which is pre-mediated/planned murder- that you were so angry or emotional that you caused a death.

This case seems more fitting for "Third Degree Murder" or better known as Manslaughter - where ignorant actions caused a death.

This is often what people get charged with in car accidents that cause deaths.

Murder in the Second just doesn't really seem to fit and since I presume his lawyers feel the same way that's what they'll fight on and the guy will get aquitted. His bond also seems quite steep for what was just simply really poor judgement.
