Paramount believes California, New York and the other states challenging its $111 billion merger with Warner Bros Discovery should have to pony up a $1.88 billion bond to offset the “extraordinary losses” the July 13-filed antitrust case and trial will cost the home of Top Gun.

A federal judge has set a September 24 date for a hearing on David Ellison‘s bold request, but Golden State Attorney General Rob Bonta, the Empire State’s Letitia James, their 10 fellow blue state AGs and the Writers Guild of America already have an answer for the Oracle scion: fuhgeddaboudit!

This is unrelated to the topic, but I wanted to share it anyway. Something similar was done before in Spain by Netflix. But this is the first time such an agreement, including international broadcasting, has been made in Turkey.

If there's anyone who's going to lose their jobs, it will be the people on the Warner/HBO Max side (Why would Ellison fire people he only hired last year?)

In fact, with an implication they might just close the currently paused deal anyway if a federal judge doesn’t see things their way, Paramount pushed very hard Tuesday.

“Ticking fees like the one Paramount faces are extraordinarily rare, in part because they are extraordinarily expensive,” the multiple law firm-repped Paramount said Tuesday in a tense reply brief over the contested bond and the long wait until the March trial start. “It would be incredibly risky to add such fees solely to deter private litigation; if the merging parties ultimately lose the antitrust litigation, the payor of the ticking fee would be left with an enormous bill and no merger,” the company added.

Unfortunately its politcal for California and the 12 ststes. They purposefully moved the trial date to March because they know of the fee paramount will have to pay to WB. If the merger fails WB will probably have to declare bankruptcy sooner or later. The studio may be sold piece meal after that. Maybe paramount will buy some pieces maybe not. But this whole thing isnt about antitrust laws. Its about everyone's favorite subject "politics". People are willing to see two old and classic studios fall because of politics. Pretty insane but also hilarious. It will like watching a train wreck. California is slowly losing Hollywood. If two studios are wrecked it certainly won't help their cause to get more films made in California. Lol

First, this suit is indeed regarding antitrust. Bringing “two old and classic studios” together with absolutely no intent to spin some of it off creates a situation where fewer films will be made. Ellison suggests the combined studio will produce 30 films a year but that creates a scenario where they will be competing with themselves. Not a great business move. All of this would likely drive up costs: for cable prices, for streaming services, for movie tickets. And who is going to see that price increase? The consumer. That’s not politics. That’s capitalism.

Second, no one has moved the trial date yet. The judge set a trial date last month for March 2027. Lawyers on both sides need time to build a case. They have to be able to collect discovery, to do depositions, to deal with any issues that they need to. Could there be a continuance? If the attorneys aren’t able to complete everything they need to in time? Absolutely. That’s not politics. That’s the way the legal system works.

The only way that I can see that one could consider the case political is in regards to the news coverage. CBS and CNN being under the same ownership does potentially create an issue where fewer viewpoints are seen. I think you and I have discussed before that more and more local news stations are owned by the same few companies. This continues to shrink the sources that news is coming from. That could be considered political. I think it’s just fucking scary that a dwindling number of rich people, regardless of their political affiliation, are controlling what news we consume.
