RMB can easily prove that calling AP a liar is not defamation, as there is very public evidence of his lying.
As for the "loan"; he would need to prove that it was a loan rather than pay-for-services; such evidence would be a loan contract, installment agreement or statement. I highly doubt such documents actually exist.
I think RMB would be smart to try and have it dismissed on grounds of improper jurisdiction; let AP try and refile in CA.

The recently revealed settlement offer makes for interesting reading as well. Shows it’s far more about shutting RMB up than any financial damages. I do tend to think RMB could make life very difficult if Alec keeps picking this fight, and Rob going public over Christmas scared him (especially with Alec now back on the crowd funding bandwagon rather than getting the OWC money).

The recent meltdown over the Vic allegations with Mecharandom42 makes for one heck of a watch as well. Alec’s properly soured the well with that plan for YouTube success before it even got started which must be a record for him.

Interesting I note Mecharandom42 says at the beginning of her video about how Axanar had been the ones reaching out about making a network of YouTube Channels. Given the relatively short amount of time Alec’s been pushing the YouTube channel again it strikes me as another classic from his playbook. “I’ve had some initial short term success so now I’m clearly an expert in this and I’m going to portray myself as a leader in the field.”

I didn't donate one red cent to Axanar... yet I have received more than four years' worth of quality entertainment. What. A. Bargain.

    What is this about?

So will RMB comment on his vids about being sued, do you think? Prudence to me says you should not comment, but we know how that went with Alec in his case! ;)

Given that the depositions from the CBS/Paramount V. Axanar Productions case are all now public record (Not to mention Alec Peter's bankruptcy and dealing with MGM and the various fan auction situations he's been involved with nearly his entire 'career'); Alec is going to have a hard time proving libel, slander or defamation to the point there could be damages awarded. His 'reputation' is hardly clean in the fandom circles he's making a living from.

As for the 'loans' - it depends on if Alec has any statements or a contract (in writing or commented on in interviews/posted comments from RMB), where they are acknowledged as such. Also, in a Civil trial (and I'm sure Alec knows this full well, as I'm sure he's used it to his advantage when on the other end, (IE when he's had a damage judgement against him) it's up to the party awarded the Judgement to collect (IE said party has to hire/go to a collection agency or other legal means to collect monies awarded) <--- So, again, assuming there's any Judgement against RMB, it'll depend of how well RMB can protect whatever income/savings he has left. If Peters thinks he'll get enough of an ROI on spending monies to get any part of a Judgement against RMB.

I also wonder how Peter's will spin using the monies from Patreon, etc. in perusing this civil lawsuit to those 'donating for the cause.'. I refuse to even click on any of Peter's Youtube Videos, but if the Axamonitor reports that a fraction of current supporters are saying "Who cares about the past; just move on give us the Axanar you promised..." once again, Mr. Peter's need to feed his ego (and part of said feeding is that his 'reputation' remain spotless, and nothing bad that happens is/has EVER his fault in any way; may come back to finally bite him hard in the ass WRT 'Axanar'.

    But hey, time will tell.

I only feel bad that RMB has to pay to defend against such BS. You would think it would have to be filed in CALIFORNIA since all the activity happened THERE. As for the "settlement" offer I can't believe it was written or signed off by an actual lawyer. You can NEVER talk to these 3 people again? Really? Is this the 3rd grade FFS?

What kills me is that Mecharandom42 was a fervent Axanar supporter at one point. She's a Disco hater who saw hope in the fact that Axanar was out there and eventually coming. It seems Alec is still a master at turning his allies against him.

I really don't get why people watch YouTube "stars"..........looking at her videos, almost every other one is listed #RANT. She seems to hate everything. Movies/Shows/Other YouTubers.......Calling the Picard show dead on arrival.....Captain Marvel will be a flop.........Discovery sucks.......I don't have time for these people.

Well then I guess I can't raise my esteem in your eyes because I listen to her near regularly, mainly for the ranting.

But it's because I listen to her regularly that I realize how significant her rant video against Axanar is. Way back when AP announced the film was "back on track" her take on it was relief, that Disco would be supplanted by a fan film that would bring back "real" trek. I don't think she ever donated money but she had at least taken a sip of the kool-aid. AP had at least one fellow you-tuber on his side. Unfortunately, because that you-tuber made the mistake of saying Vic should be considered innocent until proven guilty, the ensuing internet spat has put her off all trek fan films, but especially his.

An extreme reaction, maybe, but LFIM tends to inspire those in people.

Since this is primarily what YT exists for now (it seems) this comes as no surprise to me. What makes it more amusing to me is how many child clients I meet who aspire to be YT stars.

As low of an opinion as I have of RMB - as he HAS worked in the Industry professionally; if he were to agree to that he could most likely bide by it as he is an adult.

Alec Peters on the other hand... ;)

Axanar: the gift that keeps on giving.

I have to wonder: hasn't Peters been talking smack about RMB? I would be highly amusing to see RMB counter-sue Peters for similar defamation claims...

...my bet would be that Peters would lose, and RMB would win.

Thanks, that was my best laugh all month. I had no idea you can sue someone to not talk about a public event. At least not in this country, which I love.
    @carlosp
Is Ananar an actual entity with a real EIN number, DBA, city license, something. Or just a name pulled out of the hat.?

Well you get that in spades then. I need only forget to leave the toilet seat in the correct position if I want to hear a woman rant. ;-)

I'm now picturing the scenario where RMB accepts this settlement, but some months later at STLV ends up in a lift with Carlos, Michael and Shawn, and it makes for the most awkward lift ride ever.

"Come on Rob, you can say "Hi". Alec will never know."
