If Fajo Had Shot Data Not Varia

No, but he wouldn't be able to go back and buy any more overpriced merch at "The Sharper Image" anymore.

Seeing as how Data was given the same status as organic life in Season 2 then Fajo probably would've been placed on trial for murder.

The important question is, who would replace Data at Ops?
 
I don't understand, why is it not murder that he killed Varia?

Or do you mean he was on trial for murdering her, but wonder if he would still be held for murder had it been Data? I really do not see why not since Data has been established as a sentient entity.
 
The disrupter might not even have worked against Data. Or at most, incapacitated him, rather than destroying him.

Even If Data was disintegrated, there might be not be any residual evidence to convict Fajo and Data was already presumed destroyed in the earlier shuttle explosion.

Data had been clearly established as a sentient creature, so it would have been murder, and it’s certainly assault and kidnapping on top of his murder charge.
 
Worf was the one who was given his job when they thought Data was dead. They made a thing about it being the second time he got promoted when a colleague died.

They could have proven that Data survived the shuttle explosion. The rest of his crew had no loyalty to him, they would have given him up just for an opportunity to escape. They had basically already proven that Fajo poisoned the river, and had enough probable cause to hold his ship and search it.
