CBS/Paramount sues to stop Axanar

I'm sure Seth M would be inclined to sue the pants off Alec if a Prelude is done. Sounds like a joke to me.

With that group hard to know. This is the group who thinks cbs should have bought axanar and let ap be making that as the new trek series instead of discovery.

About 'Prelude to Orville'...

1) Huh!? (Most likely a joke.)

2) If it's a serious suggestion, FOX and Mr McFarlane should keep an eye if any crowdfunding or merchandising appears.

3) My thoughts? It's been a slow few weeks, and before we jump all over something like this, could it be another hook to see if any of us bite, ala the new studio location that was a plant?

I don't think they are currently having any plans to do an Orville fan film mainly because that would involve actually having to film something but I find it interesting that after the lawsuit and everything else they are still so quick to mention stealing even more IP. It was like they learning nothing from the lawsuit and the guidelines.

I think it will be a cold day in hell before they make anything because right now they really can't afford to and I don't mean just money. Right now they have a dedicated few who think they can do no wrong and are the most amazing filmmakers ever because of Prelude. The hype at this point is so high for any movie that AP does from his dedicated fans that there is no way it can reach it. It is better to let them believe what he could do and wants to do then see what he actually does. Better to live off prelude then to actually try to make something else.

No, the route he is going to take is try to partner with other fan films, let them film at his clubhouse and then take credit if it's good and if it isn't he tried to tell them and they wouldn't listen to him. That is far better for him then actually making something himself that will never live up to the hype.

I wouldn't be shocked though if he did try to steal some other IP to use for a fundraiser but I don't seriously think that's in the plans right now.
 
I don't for one second believe that AP would make an Orville fan film, especially any time in the foreseeable future, but that's a different question from whether he said he would. Right?

If I recall properly, Ellison's script refers to the Guardians, and as a humanoid race, at that. TheGuardian as depicted in the show,only comes up in Roddenberry's extensive rewrite. So, I wonder if Ellison would be entitled to any compensation for that.
Hoo yeah. Because if it were that easy to use a character without paying an author, everyone would do it. Secondly, The Guardians were humanoids only in the first draft. By the second draft Ellison had replaced them with a voice emanating from the time Vortex. All the Trek staffers did was "cast" a giant donut in that part. A lot of these WGA rules are designed to protect writers from being endlessly exploited by greedy producers and studios.

What if the character is created by the showrunner/producer?
Staff writers are a different matter entirely.
 
I remember reading in another topic here on Trek-BBS last year that in England, the character creator does indeed "own" the character. That discussion went on to say it doesn't work that way here in USA.

My umderstanding is that, if the creator of a character is a freelancer, his or her original elements of a story stay their property -- or at least it used to be that way, no idea if it still is. If you were part of the writing staff, the show owned everything. On Doctor Who, the Master was created by someone on staff, the Daleks by someone not on staff, so it's easier to use the former.

There's also a difference with tie-in books. If you create a character for a Doctor Who novel, you can use the character in your own books as long as you leave the Doctor Who stuff out. Hence book series based on Faction Paradox, Bernice Summerfield, Lethbridge-Stewart, etc.

A lot of this depends on contracts. For the right consideration (and so long as it isn't illegal), a lot of this could just be spelled out in contracts, either for freelancers or employees, etc.

Urgh. It does speak to the mentality of the remaining fans that they'd think CBS should apologise. But, then, for that camp, the lawsuit will never be anything other than wrong.

And besides, from what I can gather, Hatch had a few projects in the pipeline that we can still look forward to seeing. And hey, I'm one of those that did enjoy his turn as Kharn in Prelude. But again we come back to the likelihood of Axanar seeing the light of day. I would still like to see the promised episodes, and its easy for them at the moment to talk about writing the scripts. But the killer is going to be when it comes time to fund them. I can't see them earning Prelude-level money again, especially given the restrictions in place. But maybe Alec will surprise us.

I do like the point above, about how its not in Alec's interest to actually film anything. Perhaps an interesting question would be around the vignette they shot with NV ages ago. I have to wonder why its still not been released, unless he's saving it to help bolster the private funding drive in some way. Actually finishing that vignette and releasing it on Youtube would probably buy them more credibility than any pictures of Alec sitting with his laptop in a coffee shop. And let's be honest, it'd either prove the haters wrong, or the haters would keep hating, and the fans would keep singing Axanar's praises. I can't really see how it would hurt things for Alec.

(My personal theory being its stuck in post-production and unlikely to be finished. Rob's probably spending most of his time on paying gigs, and I have to imagine he's backing away from Axanar, since he's not going to direct the feature anymore and I'd be shocked if he directs the shorts. From the podcasts it was clear he was more sensible about the production than Alec, and I'd imagine the dream is over for him).

If they are joking to somehow waste time of critics, they still haven't woken up.

They are defending a sunken pirate ship. They admitted in court that their fair use arguments were generally undermined by conceding their conduct was an overstepping of copyright. If they ever try it again, the ghost of Loeb will haunt them. The ship is in pieces at the bottom of the sea, and new treasure chests are not to be had.

Arr! The jig is up, me hearties.

Geeze. Why should cbs reach out to Alec and apologize? These people think Alec is more important then he is.

I don't think getting sued even gets you on that Christmas card list.
CBS is laughing. They knew that the settlement would effectively kill off Peters even if the case never went to trial. Look what's happened. He's in a mess. Still begging for support. No longer in LA. Sets dismantled. No schedule or contracts in place for the making of Axanar, let alone anything else. An apology? Ha ha ha ha.

He's carrying on the con, both directly and through his surrogate Lane, and the Axaprats are STILL gullible for it.

I find it astonishing and alarming in equal measure.
