CBS/Paramount sues to stop Axanar

    Axanar published a blog post today purporting to tell the "truth" about its finances. Turns out today's "truth" is exactly the same "truth" they purported a month ago, apparently under the theory that merely repeating the stuff — which AxaMonitor already fact-checked and found wanting — will make it truer.

    The one bit of news was that the "independent" financial review committee — composed of three conveniently unidentified members — has finished its review of Axanar's finances and are preparing a report destined for AxaDonors.

    I'm thinking it's not on his wall as I can't see it there (unless it was a post only going to friends, that sort of thing). Will keep looking.

    I just can not find any way to spin any kind of read on that that doesn't crush my Star Trek spirit.


    Nope. Much in the same way the televangelists have always and continue to reach out to and pull in good people to believe in them and send them money to continue their True And Righteous Projects, this person still has the ability to hold onto many good people. Even knowing when he lies straight faced still they look to find ways to interpret them so they can continue to believe.

    Belief may be the most powerful non-disease data processing disconnect that challenges the human brain.

    Even I who was a believer too recognize the longing I still keep having while investigating all this to find something, some small anything that I can grab onto and say to myself 'It wasn't all a lie'. And I have just over 365 days since I was able to, with an aching heart no less, call bs on what I was seeing, reading, & hearing from the defendant himself. And I still feel the urge to believe again after all this time. So how could condemn them. How could I demean them. I can only hope for them. And keep gently typing and talking facts with which they too might connect.

    I haven't really been following Axanar since the announcement that the suit was dropped when Beyond came out. Seems like it turned into a huge quagmire based on reading the last few pages of this thread.

    No, it's not a quagmire at all. The case progressed along normal lines. Mr. Peters had many opportunities to take a settlement and refused. Either he believes he has better than a snowball's chance at winning (hint: he doesn't) or he took advice from Captain Jack Sparrow: "I love those moments. I love to wave at them as they pass by."

    I think it may have felt it needed to when Axanar turned on the whole community. At least, those members of the community who had the temerity to not believe everything they were told by Axanar.

    I think one of the major things with Axanar is, regardless of personal feelings towards Peters, is the attitude towards CBS and their treatment of Star Trek and fan films. There seems to be a strain of anger towards CBS in how they have produced Star Trek and compounded by the institution of the guidelines. Basically, it comes across as CBS is the big bully in their dealings with fan films now, and Axanar was the sacrificial lamb.

    If that sounds like I'm taking Peters' side in this at all, I'm not. I know that CBS has a right to do whatever they want with the property. But, the frustration at them for changes forcing other productions to change or shut down still seems very much alive.

    I don't think the entire community has turned against Axanar, possibly due to the fact that they disagree with CBS more.

    The guidelines were only written because of Axanar. For 50 years they let folks do what they wanted. I don't see a big bully. I see a company that was forced into drafting SOMETHING because a guy raised 1.5 million dollars with their IP..........and then blew it on everything BUT making the film.

    You'll get no argument from me. But, the reactions I have read around several sites is one that CBS is at fault for the guidelines and they are draconian in their purpose.

    But, corporations are evil, right? :shrug:

    Makes my head hurt.

    I think those that are mad at CBS honestly don't know the full details of Peters actions. Most Pro-axanar people seem to gloss over the studio, the merch, the paying himself, if it gets any mention at all.

    Peters wasn't like the other fan films who just happened to raise 1.4 million dollars.

    I refuse to share such a load of nonsense on here but I notice Mr Lane has been sick all over his keyboard again and it's resulted in another Fan Film Blog. The gist this time appears to be that Axanar could win on appeal because the Judge has f**ked up.

    That and the usual didja, toldja and, I gotta tell ya, PLENTY OF CAPS LOCK!

    Uh...no. Back in the 90's and to a lesser degree in the early 2000's Paramount engaged in multiple scorch-and-burn litigations against the fans (including Rod Roddenberry until he bent the knee) for fan-run websites containing fan-made artwork, selling fan-made memorabilia, garage resin kits and other trinkets, etc. In fact, the "fair use" laws arguably came out of those early litigations back in the 90's with all the Trek-based websites popping up everywhere (including mine). We were all waiting to see where the hammer would drop next for the past 20 years.

    Yes, Paramount and CBS throttled it back in recent years mostly because Trek experienced a massive dry spell since Enterprise tanked and they ostensibly needed the fandom to keep the interest alive without having to pay a cent of their own money for marketing. They did absolutely nothing at all back in the 60's and 70's because in their eyes, it was a dead franchise. Of course they wouldn't waste money to protect it back then! Now, since the Abramsverse movies have generated their own momentum in the franchise again and the creation of the new series (which conveniently seems to take place in the exact timeframe and prime universe of Axanar), Paramount and CBS is back to their old games. Axanar was a "low hanging fruit" that they knew would be an easy target to make a point, and an example, with much of the credit attributed to Peters' own arrogance thinking he could get away with it so blatantly!

    Don't think in any way that I'm making excuses for AP or defending him. He fucked up...bad. And now he's going to pay the price, but with other people's money, unfortunately. But I call bullshit that CBS and Paramount are benevolent victims that magnanimously allowed everyone to run a free ride on their property all these years. It's just flat-out not true.

    I know that other fan productions had and continue to have a good relationship with CBS so I disagree with your opinion. This was something that needed to happen because LFIM was pushing way past what was acceptable by any measure.

    I don't think their victims but I also won't label them as bad guys for protecting their IP. As I said in my initial comments, this is more my reaction to remarks and statements across the vast electronic wastelands that CBS is the big meeny-head who dared to impose mean rules.
