CBS/Paramount sues to stop Axanar

I'm reminded of the separate lawsuit that Alec was served at the same time as Axanar. Whatever became of that one?
I've not heard about this. Do you know who brought it or what it concerns, or where I can go on the internet to get more information about it?

For those who don't follow things in the CBS/Paramount v Axanar group on Facebook, am currently reading through this specific comment thread and it appears Terry is sitting on a metaphorical nuke he'll drop on Alec & his brain-dead followers if they don't back off/shape up.....

To be fair, back when some of this came to light, I said that Mr. McIntosh was ethically and possible legally in the wrong for not leaving any and all data and software behind when he left Axanar. And if you read my posting history, you can readily see that I have been highly critical of most of what Axanar has done. I'm not one of the Axatards drinking that Kool-Aid.

Terry says Alec retained the original lists that needed to be cleaned up, and to me that sounded legit - if there was no contract to turn over methods of cleaning up lists, or cleaned up lists, then its goodwill as far as I know to give that work to Axanar.

But what about anyone who signed up through Ares Digital? It would be ok I suppose to just flatfile download that info to Axanar, but did it happen? I would imaging Axanar being a client and beta tester hosted on the developing product they do not own. But agreements could change this.


He must not have been under contract. If he was than Alec wouldn't have been negotiating too buy Ares Digital, they would already have had terms. The quoted exchange makes it clear that both Alec and Terry know it and the data are Terry's and he's due compensation to turn it over.

How did the studio asset become business collateral which could be signed over by Alec? Only if Axanar Productions claimed ownership outright, exactly what the critics have been saying.

Apart from the million dollars that was raised, where has the money from the sale of the studio/warehouse gone and how much was it sold for?

I keep wondering that. Somewhere I lost track of the current state of it. Was it "sold"? Did it remain property of Axanar Productions and get a set of "investment partners"? I thought they put that money back into the production budget. And its gone? And all the indiegogo? Surely rent and attorney fees couldn't have eaten all that up?

Is it funding the self-contratulatory-fallen-heros-epic-documentary?
 
There is no second lawsuit that I can find anywhere online. @Firebird do you mean a second law firm? So far, they do not seem to have materialized.

I swear I remember in the original Axanar blog post when they were served with papers that Alec was served a separate lawsuit, naming himself as the sole defendant.

Axanar Productions and Alec Peters were served separately, but it's the same lawsuit. For all intents and purposes, Alex Peters is Axanar Productions. AP=AP.

I must say I'm confused as to why this Terry McIntosh is being touted as a good guy in some social media circles. I get that people are pleased he's left Axanar and he's drip fed a little information regarding some of the machinations that went on behind closed doors (I was going to write 'behind the scenes' but.... ) but I still remember him as the guy who actively insulted donors and was generally offensive to those same people who are describing him as a 'friend' now.

Equally, these snippets he's "unleashed" now are only in response to him being slated by his previous cohorts not from any particular desire to put the record straight. If he really was a decent person interested in things like the truth or doing the right thing he would've made clear everything he knows already and then, maybe, some of the Axa-faithful could make better decisions based on the right information.

But I think now, as then, Mr McIntosh doesn't actually give a shit about Axanar donors so unlike many others I find it uncomfortable to applaud his actions.

Last night, I was catching up on events after being out-of-town for a few days.

I read Terry's threat to Alec and various places talking about it, mostly praising him. I said to myself, "Wait, he's a good guy now?"

No. I remember his attitude before he fell out with Peters. Wonder when Bawden and the others will turn. [/cynic]

Dollars to donuts Peters is hiding/sheltering the $$$.

I presume that Industry Studios (or whatever they have re-branded it this week) refers to the production entity owned by Alec, which has leased the space from a third party and is attempting to profit by sub-leasing that space to other productions -- not the physical space itself. But I could be wrong.

Exactly my thoughts. And I also don't trust this Terry guy. But I don't want to accuse him of mole tactics either.

To my jaded eyes some of it appears to be bordering on sycophancy which, I think, teaches us that people will forgive nearly anything if there's a chance of some gossip at the end of it.

I think Alex told people stuff that wasn't true just to get them to do whatever he needed done.There are not a high percentage of people that understood what you could or couldn't do in the Star Trek Sandbox. Now you hear people that questioned Alex at the time, tell that Alec was in close contact or is working on a licensing deal .... so it was perfectly alright to do it.
 
I finally found "Ares Studios" on Google Maps: 28757 Industry Drive, Valencia, CA 91355

It's the end of a five-segment row-building. OfficeSpace dot com lists it as 15,756 square feet, leased as of July 2015 at $7.08 per square-foot per year, or $111,552 per year, or $9,296 per month. Now, I'm not entirely sure if that 15,756 SqFt is just for the one segment or for the entire row, in which case the numbers would be one-fifth of what's listed.

I cannot find out who actually owns the building, but considering that it's not a stand-alone "warehouse", I doubt that anyone from the Axanar staff bought it to lease back to the "studio". Until now, I wasn't so sure about that ......

I still am stuck on the whole, how does one manage to raise 1.3 million dollars and have none of it left. None left to send out donor rewards, none left to make a production they promised to spend the money on and none left to pay your CT guy for the work he did for you. Every time I think this whole mess can't get worse for Alec and his gang, he says something else dumb and pisses more people off. Which then plunges Axanar deeper in the hole. Honestly, I am glad I was a donor, the entertainment this entire fiasco has given me was well worth my 30 bucks far beyond their "fan film" production would have...

If there's any confirmation to this one claim that they have no money left, it sure seems like they are going to get plenty of press attention over the "where did it all go" question...
