Yeah, "he said, she said" won't get anyone very far in court. I really believe that when the other shoe drops, it going to be the equivalent of several pairs of concrete galoshes.

The way I read it, if they cannot confirm or deny whether Lin/Abrams knew what they were talking about, it could be a first salvo at claiming that whoever spoke to Lin/Abrams was not in effective contact with the legal team and their direct clients, and therefore did not know the real bottom line. This might lead to plausible deniability if they want to walk back the Lin/Abrams statement in any particular regard.

I wouldn't read that much into it. The construction, "lack knowledge or information sufficient to form a belief as to the truth," is standard legal verbiage basically meaning, "prove it."

I find this Intriguing: Ken Ross attended a 'portion' of the PtA showing. Was he scouting it for CBS or something?

Then add:

1. Ken Ross from CBS attends a portion of the PtA showing in 2014. It's decent. It's definitely Star Trek.
2. this guy is saying he's now making the first independent Star Trek film
3. he's promoting fans getting what they want by funding it themselves
4. speaks out against paying for cable
5. brings up streaming services as an alternate for content delivery
6. and says they want to be part of that

See, if *I* was the owner of Star Trek that list says to 'me' that this guy is using my product and doing a decent job to go into direct competition with me.

And *I'm* getting ready to launch my own streaming service. Using this very product to spearhead it.

And there's a bunch more like him, and better, coming up behind him with affordable high quality low cost technology using my product?

I would say, yeah, this has now become a threat to me and my business. It was different when no one was saying they were trying to make my product and compete with me using it. Yes, I'd get together with my legal department, get my ducks in a row, then put my legal foot down too.

If all the stars had aligned... If the lawsuit hadn't come along... If Axanar were produced... If they were able to get the venture capital to start their service... this would, at most, have been a boutique streaming service -- something like Mubi.com, where its a smaller user group and not as well known. But would it have been real competition for Netflix, Amazon or Hulu? Alec is way too late to the game for any of that. Netflix was really the first to do it well and they had the disc service to start them out. Hulu and Amazon had multi billion dollar corporations behind them to start. No way Peters can compete with that. And I think he probably would have gotten annoyed with that and either sold the company or abandoned it.

Regardless, you're correct. There's no way with statements like that that Axanar wasn't getting sued.

Seriously? "Industry Studios"?? Like that's going to stand out in the movie industry. If you're going to have a niche business, you need a name people will be curious about when they see it.

If one says, "The best fan-film are shot at Industry Studios", most people will read it as "The best fan-film are shot at industry studios", which means something entirely different.

Oh, they had settled on a name - but they revealed the name too early and therefore Alec and the Secret Band of Investors had to change it quickly. Fortunately they had a corporation already set up waiting to be used - a corporation that was created in December of last year. It's almost as if they were planning to do this all along.....

ETA: In re: the Trekyards video... I wish he would get his ugly mug out of the shot. I don't want to see that.

That's kind of a hallmark of Trekyards. Here's how most of the videos look.

It doesn't change or cut away from the talking heads, or zoom in. I don't know who told them it was a good idea to fill 1/3rdof the screen with fake computer graphics.

There was a time not long ago when MySpace and Yahoo were category killers.

Granted, Alec might not have the industry chops to stick this out. But attract enough investment and the professionals will join, then sit back and be the boss till they ease you out with your platinum parachute.

I've been arguing for the better part of this thread that the real issue here is competition in new media by ever cheaper ever better technology/distribution opportunities for tent-crashers. You gotta draw the line hard on your IP. This was a nice tying together of a possible Red Alert moment for the studios.

I had the impression that making simulations is his main activity. And besides, if I had to maneuver a starship into port, I certainly would want my controls to be "Alpha, Beta, Mode, and Return" and buttons with initials of the crew on them.

Its an LLC, so now you can't see who is involved except for the representative who filed the papers. I'd say that may be more the point.

So is it Axanar Productions that has morphed into Industry Studios? Or is this a separate holding corp for the facility? In short where is the fundraising money sunk into the facility (as if the transparent accounting really makes that amount clear)? Did it get paid back to Axanar Productions for use in making a film?

One of the main things that AP wanted to do with his streaming service was to be like Sci-Fi Channel in the early 90s and stream old school sci-fi shows. I'm not denying the fact that something might supplant Netflix and the rest. It's possible. But Alec's vision of a streaming service? It's a pretty niche market for that. He suggested there will be millions of subscribers. I argue that said niche market would be tens of thousands of subscribers.

First, while this is a growing market, I'm not convinced that many will be interested in watching old episodes of The Twilight Zone. Or The Time Tunnel. Or Manimal. Second, knowing Peters' propensity to overcharge for things, I think he probably would not price this to move. I'm not saying there wouldn't be subscribers. I'm not saying that the base could even go beyond what Axanar has brought in. I'm just saying that I don't think the model is sustainable at least without some serious bank.

You suggest that new media distribution is becoming cheaper. Fair. But you still have to pay for content. Which means that Alec will have to get the rights to stream the content. And he'll also have to pay a licensing fee. Before the suit, maybe there was a possibility that he could get some content, but not enough to draw a ton of subscribers in. Not to make it profitable. Now, there's no way in hell a major studio will license anything to Alec Peters.
