CBS/Paramount sues to stop Axanar

So today was the day to write an update to the Axanar saga. I go through the 28 pages and the explanation by the very helpful Axamonitor site that explains the legalese to non-lawyer types like me, and when I get partway through the initial document, I start laughing.

They provided a story on how the ittle-wittle Alec was so enraptured by Star Trek that he convinced his mommy to wake him up at 10 PM to watch it.

Really? I feel so, so sorry for the judge. This is their defense; that he's a super fan? REALLY?

No, no. Read the countersuit and answer. He's using the I'm stupid and don't know anything defense. :guffaw:

Is there a kid in jammies watching TV somewhere in the Code of Hammurabi? Didn't think so. But 500 years from now, court cases aboard the Enterprise could cite this image. Promenades might even sell dolls. Immortality!

Well not really, because ignorance is no excuse for breaking the law. So "not knowing" is no defense. I think it's more along the lines of he was trying to navigate in murky waters, trying to run the right path with no clear guidelines and C/P refused to help. Still, that's not really a defense, unless -- . Hey! That's it! C/P refused to help. Therefore, they set him up! There's the defense!

Actually, I think they're a step away from saying C/P let everyone else get by with it to that point, so why would Peters think he would be any different just because he wanted to do something of a little higher quality? Still, that gets to the thorny issue of C/P choosing to enforce it's IP rights as it pleases. Everyone else was doing 37 to 40 in a 35 mph zone and C/P let them go because it just was not that big a deal. But Peters was doing 80. So yes, selective enforcement based to an extent on common sense. Doing 80 in a 35 zone is dangerous and cannot be condoned. (And someone doing 80 in a 35 zone without realizing it is very wrong sorely lacks common sense.)

Besides "Everybody else is doing it" isn't a valid defense either. Copyright holders can go after whomever they want, or nobody.
 
You predicted that Defense would not file an Answer until the very last minute, or perhaps miss the deadline entirely. But then just 48 hours later .......

I realize you were being humorous there. Definitely! And I think I remember that part being accompanied by 'I think' and/or 'I suspect' 'I speculate'


And, well, that's the thing isn't it. We aren't actual participants in it. So none of us really know do we. LOL

The more educated of us in the legal matters and personal knowledge of the defendant give us more educated possibilities to consider, speculations. The gatherers of verified & verifiable facts give us more with which to educate ourselves with for clearer insight. The non-educated in legal matters or personal knowledge of the defendant among us (-->me<--) are conversing and speculating from our own interested though somewhat limited knowledge perspectives. Ditto for those among us with legal and personal knowledge falling somewhere in between.

So, I'm on the lowest end of that spectrum, absolutely. And I find myself thoroughly enjoying my attempts to learn bits and pieces of How Stuff Works in the legal world related to IP as well as this defendant and case. The lawsuit was the impetus, the point I began my interest in this knowledge. Then I sometimes come to my own tentative speculations as I learn a bit more here and there.

Which I sometimes revise or discard after some new information comes to my attention, or those more learned that I give me information showing my line of thinking to be inaccurate in some way.

And sometimes I do not. LOLOL

Which, btw, the part in this week's podcast about the speculation on the Mr. Abrams thing had me thinking 'Hmmm... I can see that.'

And that observation I completely missed about Mr. Lin sitting silent the whole time Mr. Abrams was talking about this? Vedy vedy interestink.

There are several voices I'm particularly fond of reading because of verifiable facts and better informed information they offer. Others I enjoy reading offer well thought out speculations allowing me to following their train of thought. Which often leads me to more researching in The Google School of Law. Finding cases supporting the information, sometimes not as much as I would have expected..... which then leads me down new corridors in questioning and learning.... and sometimes personal mindwalks into new speculations of my own. Then repeat repeat repeat.

It's becoming sort of like what will in the end be a small and short lived study course in something that gives indications to be possibly primed to have great impact on part of this world of Trek that I love. Periodically interspersed with dollops of sadness or hilarity, sometimes jaw dropping incredulity at the.... well, you know.

And while I use the information I get from the legal knowledge of some, and the facts I learn from others, the prior knowledge I get from those previously involved with this particular litigant, and the possibilities/speculations expressed by others ..... that leads my own further inquiries into more information, I do continue to think for myself in how I feel or think about this matter.... and the players in it.

Oh, yeah, and what's 'really' got my interest right now is what's going to happen with this counter claim that's on the table!

Could Abrams and Lin supporting Axanar have an effect on the chances of them working with CBS and/or Paramount or at least in the Star Trek franchise again? I could definite see supporting the other side in a lawsuit pissing off the studios enough to not want to work with them again.
 
Paramount and Bad Robot have a really good relationship and a deal through 2018. Its been renewed several times. I don't know this misstep will mess that up. It might. But I wouldn't put money on it.
