CBS/Paramount sues to stop Axanar

Hmm let's see. I'm the owner/founder of the industry's largest audited AV Magazine that deals with copyright on an almost daily basis since I started the site over 16 years ago. Yea I do know a thing or two about it and I am interested in seeing how this lawsuit plays out.
Maybe, but it seems pretty clear to me, as a layman, that Axanar violated the Trek copyright, and then to make matters even worse, tried to profit off of that violation.

I'd love to her more about how I can legitimately breach copyright. There are some franchises that I would like to make a salary on. Any suggestions, @AudioGene?
There's probably good money in reviewing audio hardware. Start a website like, say, Audiocaholics, and do reviews on technology, with the occasional smattering of editorial commentary regarding franchises you don't like. If you're not sure where to start, just copy and paste a bunch of stuff. If it's out there, it's available for free anyway. If all else fails, call your website a non-profit, but only pay yourself a barely minimum wage salary to keep the haters off your back.

The cable model is dying, and in it's wake CBS's experiment is leading to us getting a new show. Do you think they'd spend the money needed to put out a SciFi show when they can make another Mike and Molly or two broke girls or NCIS: Delaware with less cost and more viewers? The choice wasn't Star Trek on broadcast or Trek on AllAcess, it was No Trek or Trek on AllAcess.

Exactly my opinion. If the show is to my liking, All Access is something that will enhance my experience as a fan. I don't have to sweat the C3 ratings, I can support the show with cash on the barrelhead, as with the movies and the merchandise.
 
Thankfully this is a small website with little visibility. So far we've gotten a whopping 35 views to this article from this forum in contrast to over 2 million visits/mo on our site.
Again, you're not being consistent. Your first post said, "Guys we wrote about this issue to get more exposure. Please share!" but now you're saying "...this is a small website with little visibility". So then why come here for "exposure"?

Your posts are as confused as the opinion piece you drafted.

If it gets to trial, in a civil case in the US, is the public able to view the trial in progress, i.e. is there a public gallery?

The public can attend, but the federal courts do not allow audio or video broadcasts or recordings. They don't even allow people in attendance to email, tweet, etc.

We need an Axanar rant checklist for editorials like this audiowhatsit and the various other uninformed commentaries that keep popping up. That way the first person to willingly read another clueless clickbait Axanar article can just say, yeah, it got 17 of 20 of the checklist items, don't bother reading it.

  • The JJ Abrams movies aren't real Star Trek.
  • The JJ Abrams movies may have been popular but nobody likes them.
  • Axanar, a cool space war story, is true to the real spirit of science and exploration and peace represented by Gene's vision of Star Trek.
  • Gene Roddenberry would have loved Axanar.
  • Axanar is the best Star Trek movie ever, even if there's no cast and no script and just that three minute scene.
  • CBS is scared of Axanar because their new TV series will suck by comparison.
  • CBS is scared of Axanar because they want their new TV series to be about the same old role playing game and the same old not very good TOS episode Axanar is based on.
  • Paramount is scared of Axanar because the Paramount movies' flashy lens flare starship sequences look lame next to Axanar's flashy lens flare starship sequences.
  • Paramount is scared of Axanar because Paramount doesn't know how to make Star Trek movies that the FANS want.
  • Axanar is a nonprofit.
  • Okay, it's not technically a nonprofit but they aren't making money on anything.
  • Okay, technically they're making money on the donor store and renting out the studio but that's not what PROFIT means.
  • Okay, it's a copyright lawsuit and profit is irrelevant but CBS and Paramount haven't protected their copyright and if they didn't defend their copyright against all those other fan films it's public domain.
  • Okay, so copyright doesn't have to be defended but why only Axanar, there's no difference between Axanar and all the other fan films.
  • Okay, so Axanar called itself a professional independent production but they're making it because they're fans and therefore it's a fan film exactly like the others, they aren't doing anything differently, they all pay themselves.
  • Okay, so they may have done things a little differently but did you see how amazing Prelude was? I really want to see the movie, why can't CBS and Paramount let me have the movie?
  • Every Star Trek fan wants to see Axanar!
  • The haters are just paid by Paramount!
  • Why can't they just let Axanar do everything Alec Peters wants and give it their approval? That way everybody wins!

Yeah, I seem to remember a case a couple of years ago here in the UK where someone got into trouble over tweeting or posting elsewhere on social media concerning the case.

Googling about tweeting in court brings up numerous entries about US cases too!

To be clear, once outside the courtroom/courthouse they are free to email, tweet, etc. all they want. They just can't do it from inside the courtroom. They can take all the notes they want in the courtroom (and I mean notes -- no recording, not even for personal, non-transmitting use) and then can tweet, etc. all that once outside.

There was a case not so long ago in my local court where the Judge allowed a woman to bring in a laptop so long as a court official made sure she was not online. This was because the woman was a partially blind reporter and needed the help

In the UK it's contempt of court to record, photograph, film or broadcast proceedings although recently they've trialled recording the judge's sentencing remarks. The judge has discretion to allow texting, tweeting etc and sometimes will for cases of big media interest. The rules would still apply re images and video though, you'd only be able to tweet text summaries.

Not only does this sound like a massive DIG at him I would say why not ask him.?. I am sure you would get a very nice response NOT!..

On a side note does this mean ANYONE who bases something in this manner means they are setting themselves up for a cameo in films etc? or just being honest??
 
You guys are quite an amusing little bunch. If I wanted to increase the traffic of my site I'd go to Slashdot or Digitaltrends to share the article, not a forum like this that doesn't even have 1/10th our traffic. I came here to share with fellow Star Trek fans and to flesh out any possible errors before publishing.

Instead I got a bunch of Paramount/CBS groupies that living in their moms basement suffering from hurtfeelioma.

I appreciate the feedback and hate but there is no reason for me to continue at this snakepit. Live long and prosper.
