CBS/Paramount sues to stop Axanar

Ok, to get back on topic, a question about the law.

If somehow Axanar and Peters got a judgement that favoured them, and CBS/Paramount then put in the expected appeal, I assume that a new judge would have to be assigned? Is that correct?

It's a whole other court - an appeal from the California Central District Court would go to the Circuit Court of Appeals, Ninth Circuit.

I will be interested to see what happens next week after the May 9th conference. With discovery being listed as a short term process, but a possible trial date set next year, does that mean that after discovery has taken place, publicly released information will be reduced to a trickle?

Did you report it? Or do prefer to stand by and ask why isn't anyone doing anything?

Also: the mods don't live here 24/7. Many of them have actual lives.
Nah. I actually prefer it when people don't complain to Mommy and Daddy and just deal with direct personal comments instead of this pretense created by the "post, not person" rule, masking personal comments behind the proxy of the post. I find the concept dishonest. That said, it usually gets out of control, hence the rules. I might not agree with it, but I understand it. And beyond the mods, there's self control, which has been greatly lacking, in the absence of mods. The mods aren't responsible for poor behavior and poor treatment of those with whom we disagree. We are.

Luckily enough, we're only responsible for our own behavior. Feel free to grab a pitchfork and flame away though if you must.

The plaintiffs are looking to have the Language Creation Society's amicus brief tossed, because it's untimely, improper, and immaterial to the motion to dismiss hearing next week.

From my own experience, discovery can drag on if a party opposes ending it due to noncooperation by the other side, or by having a case to ask more questions than initially planned. Some details can emerge in these filings.

My experience has been that discovery info isn't released in any way just because it was obtained, but is material which can be cited in filings or in court as each side desires.

From what I have experienced, if summary judgment filings are made, and I believe both sides indicated they would be doing this, there probably will be discovery information attached to it, so details (although probably not everything) could emerge before trial.
 
I am confident the judge will give the LCS brief all the attention it is due.

I'm not a parent, but if I did have kids, I'd rather know in advance what the content of a TV show / movie / book is before I let them see / read it.

That's what the rating system is for. And when/if you ever become a parent, you will quickly learn that the ONLY way to know for 100% certain that the content meets with your approval is the watch or read it yourself FIRST. Because every parent has different rules for what they want their child to see (as this discussion proves) and every child has a different level of content that they can "handle."

In 2009, my son was only 7, and so I saw Star Trek in the theater first with my friends before I decided to see it with him, after deeming it OK. Is that ideal? No. Would I have loved to see it for the first time WITH my son? Of course.

But that's what being a parent is all about. Concessions to do what's right for them.

That's strange. The dvd Prelude to Axanar cover you posted shows "the Klingons came and we flew around from behind the planet and surrounded them, and our main ship is bigger than all theirs put together".

Isn't that the whole plot?
