Ironic, being that he's really more of a nightmare who doesn't, you know, work.

Alec's history of collecting a large amount of very valuable props could be of interest to C/P should there be significant damages awarded. I'm guessing they comprise the bulk of his net worth at this point, and may well be worth far more than the studio assets.
Someone told me that he had announced in the Star Trek Prop and Costume forum that his collection was now owned or controlled by a trust, and that he would be selling much of it off. This was a few weeks ago I think.

None of that surprises me. I predicted before page 300 that he'd be squirreling away all his assets, and just dragging the whole thing out to take in more money for the film that he knows will never be made. He seems delusional, but he has a plan, and he moved on from Axanar mentally the day he was served. IMHO :angel:

Not knowing any of the specifics of the transfer at hand, I would think that C/P - if it even cared that much - might challenge the transfer as a fraudulent conveyance (a conveyance done with the intent to defraud creditors, including potential creditors in litigation) depending on when the transfer occurred (i.e., before or after notice of the lawsuit) and other circumstances surrounding the conveyance. Some factors the courts look at to determine this intent include (i) whether the transfer was for fair market value (not sure how this would work in a trust situation); (ii) whether there was a lawsuit pending or threatened at the time of the transfer, (iii) whether the debtor retained possession or control of the property transferred after the transfer, and (iv) whether the transfer made the debtor insolvent (unable to pay the judgment). (A similar analysis would apply if the debtor made the transfer in an effort to shield these assets from bankruptcy, such as the bankruptcy one would file for protection against a judgment from litigation.)

Again, I have no idea about the circumstances of the transfer in Alec's case (or if it in fact even happened, or how long ago) - I'm just noting this would be one avenue that any plaintiff would investigate if they get a money judgment and the defendant claims he doesn't have assets to cover the judgment or files bankruptcy.

but how on Earth will he be able to save face regarding his Donors, the Axafold, future conventions?

Would that be possible? That (next year) another Linnear, Loken, Red Omega, GarthOfIzar would arise like a Phoenix... AGAIN? Selling Props?
 
Well, fortunately the Internet rarely forgets anything. There's been enough of a stink made about all this that if Peters tries this shtick again, there's more than ample evidence to point to about why he's just (literally) bad news.
 
One of the things I enjoyed about the Plaintiff's response is that it passed the "smell test." The language was clear and understandable, the arguments were structured in a logical fashion, it was written to be understood.
The defense's arguments have been opaque, almost as if they are trying to bury the issue under so many unrelated arguments that they will confuse or irritate the judge into hand waving the case away just so he isn't bothered anymore.
Reading the response from a layman's perspective the Plaintiff's clear argument was quite refreshing after having had to sort through pages of junk in the 2nd MtD.

It's not so much Peters, as it is his Lawyers... and they are just grasping at straws I think, drawing this out as long as possible, to create time for settlement negotiations before stuff gets expensive with Discovery....
 
I think their strategy right now is just to be as annoying as possible. Delay as long as possible. Try to get on as many blogs and podcasts as possible. Try to get CBS to deal with things like the Justin Lin tweet as much as possible. Trying to get CBS to settle before the new movie opens up along side human intrest articles about CBS suing the fans. Axanar would love this to be going on when Beyond comes out.

Of course they're missing one big point. CBS doesn't care. Axanar is only a topic of discussion amongst those of us who are also discussing "Star Trek Raven" and "Pacific 201" And only because we've beat the KBoP size discussion to death years ago. Look at how CBS dealt with the Justin Lin tweet. That was probably the biggest egg in the face moment for CBS. In the end no matter what Axanar thinks they won't be a black eye for CBS and CBS still has no reason to settle.
