CBS/Paramount sues to stop Axanar

I don't rent my sets, I don't charge for anything and I certainly have never gotten any salary for playing Trek with my friends. There is no question in my mind that CBS owns STAR TREK. They have been very gracious to allow us to play in their sandbox for many years. We have always had a good relationship with CBS and have always complied with any request that they have made of us and will continue to do so. If CBS says stop making fan films, we would abide by their wishes and say Thank You. I have spent far too much of my own money for many years, 15 of them to be exact, Far more than I care to think about, I did it for nothing but the love of the game, if and when it ends at least I can say I played by the rules I was given when I cross the finish line.

This is such a refreshing post, and it is because of people like you that CBS has been so tolerant over the years. They know that people like you are a boon to them, and they want to keep you around. I hope that once the aberrant "production" has been excised that things will get back to normal and those of us who enjoy watching fan films can do so without having to wade through all the extraneous nonsense that Axanar has generated.
 
James and Vic are both shining examples of what fan film enthusiasts can and should be. They set increasing expectations for their production quality while not losing perspective. Based on James' comments here and Vic's comments on 1701, you can tell neither has delusions of grandeur or feels entitled to CBS' IP. They're also not thin-skinned misfits trying to control discussions about their work.

Wow - I look forward to seeing how the Axanar folks (and Alec Peters who lauded the motion to dismiss; and crowed how C/P decided not to file a response.) will attempt to spin the fact their motion to dismiss has been denied.:whistle:;)

It is a routine consequence of C/P refiling. It says the prior Motion to Dismiss no longer applies to the case. There is really nothing to spin or protect against, it isn't any sort of assessment of the content of the Motion to Dismiss.

Well, in fairness to Axanar (yes, they do deserve fairness sometimes when due), their motion wasn't "denied" - instead, it was deemed "moot" meaning that the court has no reason to rule on whether C/P's original complaint should be dismissed given that C/P has now "replaced" the original complaint with a new one. Axanar can always file a new motion to dismiss the new one.

Oh trust me - I know how it works, and it was indeed 'denied as moot' (and technically it was still 'denied' ;)); but still, when C/P didn't answer and instead just filed an amended complaint (also a very standard court procedure and not uncommon); Mr. Peters still chose to crow a bit about how C/P didn't file an answer; and tried to spin that a bit.
 
I noticed a day or two ago it was mentioned that pro Trek novelist Dave Galanter helped with the Axanar script. Has he said anything about his involvement with it since the lawsuit? Knowing how much Alec Peters like to lie and exaggerate, I was just wondering how involved Galanter really was, and if he could be effected by the lawsuit.

They have both accorded themselves admirably during all of this controversy, yes, but let's not put them up on pedestals. Neither tend to take criticism (the nasty kind or the fair kind) very well, but likewise neither of these fine gentlemen resort to petty insults, threats, foaming at the mouth rage, or attempts to control the narrative of behavior and conduct the way Peters does.

It's taken me some time to realize all this, but James is a very sensitive person. That's not a criticism - it's a compliment, as I truly do believe it is one of his greatest strengths as a storyteller.

Vic however has no problem deleting away any negative comments and moving on. He's a skilled propagandist with his content and while it's not my favorite quality, it's certainly his right to shepherd his project this way if he so chooses. It seems to continue (see what I did there?) to work for him and so far as I can tell, he's been able to do so without breaking any laws, unlike...

Alec Peters, who, on the other hand, insults and attacks anyone he perceives is against him. What constitutes being "against" him? Seemingly, anything that doesn't fit in to his narrow worldview. What constitutes his narrow worldview? Unadulterated praise and adulation for... (wait for it) ...Alec Peters. He trolls, insults, threatens, cajoles, intimidates, bullies, doxxes, and interrogates anyone who dares to ask the questions he doesn't want to answer, or who point out the crucial flaws in his misbehavior and conduct.

When considered against the sheer idiocy of Alec Peters, I would stand with James and Vic any day.

We've covered this in this thread, and Galanter has gone on record about this at Axamonitor.

Dave's involvement was minimal.
