CBS/Paramount sues to stop Axanar

Since it seems to still be the crux of Axanar's defense, legally and online, I guess this is still relevant:

Since they can't shoot Axanar right now. What is stoping Alec from renting the stages out to another production? It going to be a while before an actual trial, discovery alone will take a long time. In the mean time, what is to stop Alec from making money renting the studio? I don't see anything legally right now to prevent that.
Most likely - There's no production company interested in what he has available at his studio; or Mr. Peters isn't really interested in seeing if he can rent it out. I recall mentions that the electrical wasn't really up to the demands needed to use it for filming and they probably blew most of the donor funds renovating the office, phone system and carpeting.:ack::angel:;)

And display cases for the toy and screen used prop/costume collections? One wouldn't want valuable collectibles exposed to dust from a busy studio...
 
Cheese and crackers. These guys are un.... be....leivable.....
They took millions so that they could fulfill some sort of teenage dream. Disgusting.

Kinda doubt they spent fan money to buy all new toys. I bet a bunch of those have been out of production for a long time.

The thing that ... eh ... I don't even know how to describe it - see, I have worked temp jobs. You bring (maybe) your favorite travel mug, perhaps a photo or two. A wrist rest if you don't get one. But you set aside all your creature comforts and you leave them at home. And this is even for a yearlong contract.

Why?

Because everything you bring in, you need to move right back out, once the contract is up. It's a pain in the patoot (to use the technical term, sushi fans). Plus you really don't want to be dealing with breakable stuff, round trip.

This does not look like temporary digs, once we're done, we're done. It looks like the long haul.

1. are those videogame boxes or perhaps Trek season dvd boxes on the desk shelves facing the guest chairs? What's the point? They are needed in the temp office?

2. been wondering what the wall quote translates to, in case it is another example of Freudian slip. Would never ordinarily say this, but there is just so infinitely much of it happening on this project...

I can't believe he's using the crowdfunding money to pay rent on the studio. That just seems really wrong to me, especially if they aren't actually using it to film the movie. Rent and things like that should be totally separate from the funds gathered to produce the actual movie.

Well here is the thing, its going to be a while until the actual trial, so until that time, legally they can rent the studio out. Unless an injunction is issued with a stipulation that also freezes up any activity with the studio. I can't see the injunction including this, since an injunction would mostly be in regards to ceasing anymore infringement of Star Trek.

The other thing is that Alec gets an essentially 'get of jail free card' with the donors. He will simply claim that CBS/P stopped Axanar so blame them for the loss. He will say he was going to shoot the movie this past February but the lawsuit prevented that. So if you feel that Alec was going to delay shooting the film even if the lawsuit never happed, you will never really know since he will blame the lawsuit for that anyways.

Right now he has over $500k of Indiegogo & website donor money and he does not have to give the donors an accounting of these funds because A) He will say the lawyers told him not give out any more financial information and/or B) the 'Haters' will misinterpret the financial report so he is not releasing one. This gives him the ability to spend the money just on the studio.

So know your thinking, well he will finally get whats coming to him when he goes to court! Well that may not be the case either. While its hopefully to think the CBS/P's lawyers will throw in all theses claims we having been talking about in the thread, there is a good chance they will not. and it will be strictly on the merits of copyright law. Damages may not be 150k each and may just be a couple hundred dollars each. He could get away with more than your think, or were hoping for.

The important thing is base this case on the merits of the law what usually goes on in the court system. Janet and Mike are great resources to understand what is going on. When the trial happens I'm sure we will have the popcorn ready, we just don't know what type of ending this film has yet. ;) [/Devils Advocate]

Did they ever get the electricity issue sorted out?

There is the question donors may ask: wasn't it reasonable for you AP to have anticipated that the risk of funding a studio from Trek IP was too high, and therefore your pitch to donors was in fact misleading?

And the action they may take: class action, and/or engaging the state Attorney General's office.

And the consequence: bankruptcy/liquidation of whatever ownership vehicle tries to retain the studio, to fund the members of the lawsuit.
