Well I am on of the ones that made NO money on this venture, and I am also a donor as well. I joined the production as a fan for my love of trek so I am going to leave it at that.believe me I am not having anything to say about any personal relationships or seeking anyone to put themselves in any position other than what they feel is right. I simply find this bait and switch of turning "make no money, period" into "make no net money after unlimited runs at CBS IP-derived income is used to equip a studio and pay operating expenses and salaries and convention visits and etc" to be flat out wrong, and hope that the Ax people eventually come to see it for themselves and put an end to it, either build their own truly volunteer project, or walk away, or whatever it takes to undo that whole business model and the consequences it has had for donors and themselves.

I think we should all be thankful Tobias didn't go antisemitic on trekbbs. Then again, I wonder what does he mean by "a very dark place"?
Also, show me ANY other Star Trek fan film group that's paying their head producer (in Axanar's case Mr. Alec Peters, who ISN'T a member in any standing Hollywood union, SAG, WGA, PGA, etc.) - because I think that's one main difference between Axanar and EVERY other Star trek fan film group. Mr. Peters by his own admission paid himself 38,000 in 2015 - which works out to approximately $18.00 per hour (quite above 'minimum wage' which is what he claims said salary equates to - and then there's also the deferred/unlisted salary amount he's paid his girlfriend.) Not to mention all the various travel expenses (paid from backer funds) to travel to, pay admission/entrance fees, and hotel room for various film festivals and Star Trek or Science Fiction conventions. Seems backer money is spent on everything BUT actual filming.

Essentially what this is saying is that the plaintiffs as going for the highest amount they can get under the statute.
And I definitely see your point re the 'ripeness' argument. If the film is ever made, then the defense is open to, at the very least, a boatload of scrutiny. In the meantime, plenty of preexisting stuff is out there.
