How can Axanar justify accepting "donations" for "Prelude.." when there is no further work left to do on it?
Absolutely. Even if this was to go to trial and CBS were to win and shut us down, we will figure our replacements for the Axanar Blu Rays, and everything else we will get to our donors! We already have plans for bonus perks for everyone f that were to happen.
They added the word "retroactive" to it.
So clearly it's not selling stuff for money, it's traveling back through time and "donating" before the film was completed.
I make a couple of inferences from this:
- Peters seems to think the most likely outcome is that CBS will, for some reason, settle and still allow Axanar to be made.
- Reading between the lines, it looks like if the above does not occur, then Peters wants that trial so he can "win" the right to make Axanar.

The talk of alternative perks for existing backers is intriguing. It suggests to me that they're keeping options open for filing off the serial numbers. Or if it all goes belly up, I guess they could use the existing Prelude perks.

If I pledged to receive an Axanar Blu Ray, I may not want the BluRay of whatever generic version of the film is ultimately made. I don't want a t-shirt of that generic movie, a mug, or anything else. I wanted Axanar, I paid for Axanar, if they can't make it, I want a refund.

Which isn't unreasonable. For myself, if a generic sci-fi version of Axanar got made, I'd probably be ok with it. Not quite what I would've wanted, but something at least for my investment and I'd still get the same basic story. You can't really blame Alec for not wanting to back down. He's been working on this for maybe four or five years (I honestly don't know). That's a long time to spend on any project. Though one would expect there to be more to show apart from a twenty-minute prelude.
He should have thought things through a little bit more then. People here were saying they were going to get sued during the first Kickstarter. If we could see it coming, why couldn't Peters?
Actually, CBS could insist that any and all perks are never issued, on any thing that violates their IP or was based on the violation of their IP with a win. That absolutely would include prelude based "Perks".I imagine the explanation here is that you're donating to the main feature, but the perks being promised are Prelude-based as they've got them in hand.
Without getting bogged down in semantics I donated to the main feature Indiegogo to receive the Prelude Bluray and Soundtrack perks as I hadn't backed to that level previously. To an extent, it's a risk-free option as you know you're definitely getting what you've backed for.
It's not a bad option. You can argue they could shutdown all fundraising, but it's not like they're accepting donations for perks that may never materialise (such as the main Axanar Bluray).
