CBS/Paramount sues to stop Axanar

The filming & production for Axanar has been postponed to February/March pending the outcome of the lawsuit filing. Filming was scheduling to begin this week

What exactly were they going to film this week without sets or actors?
Were they going to dress up the carpet installers in Starfleet uniforms for the "building a starship" scene?
 
The fact that NV released a new episodes 3 weeks after the lawsuit was announced, and a week later there is no sign of legal action is a good sign.

One thing I would point out is that NV and ST:C have been around a while, and from what I've seen said, it appears that they've both had a lot more direct contact with CBS legal than any other fan production.

Don't assume that just because ST:C and NV are okay, that anyone else is. Don't assume that they're not. Be smart and proceed with caution. :)
 
I still can't believe there are actors, directors and crew willing to continue in spite of this lawsuit. Even if you believe in Axanar and somehow think they'll win this, wouldn't you want to abide by the law? If for no other reason than to preserve the integrity of your career?
 
If you don't protect your patent, and set a precedent of allowing others to infringe, I understand you can lose rights. However, my understanding is that 'precedence' is not a factor with copyright. You can pick and choose to respond or not, you don't have to create a paper trail of licensing each and every user. Could you imagine if every 'fair use' quote in the news had to be licensed?

So the idea that the history of picking and choosing that CBS has followed establishes legal protection for Axanar is just not sound. Its not backed up by actual law *or* case law precedents as far as I have been able to see in my non-legal capacity.

If anything, I have found that selective enforcement of an copyright, MAY impact damages awarded not actual judgements
 
Well according to one tale going round, most fan works are shutting down because of this lawsuit

You know what would be funny? If ST:C or NV announced their next episode would dramatize the Battle of Axanar, with the same low-budget actors, sets and makeup/wardrobe.

And it got through. I'm not a fan of these fan-films, but I would watch that just for the irony.

That would be hilarious - the war could start because the Klingon believe that someone in the federation is making a Fan fiction version of 'Tales of the Black Fleet' and Klingons take IP very seriously...

what about trademark? isn't it true that trademark does have to be protected? that "Xerox" lost its right to enforce against Xerox becoming a common way of referring to copies/copier machines, because they didn't constantly claim the exclusive use of the word (Xerox-brand copiers)?

Is there trademark going on in this suit?

From what i've learned, trademark doesn't HAVE to be to retain it, but it really helps, and lack of enforcement CAN hurt the chances of future enforcement.

But i'm fairly certain this case is strictly copyright related.

Trademark is different, and it must be protected... So far nothing in this suit mentions trademark protection, just copyright.
 
It is awful to read this. I have never been angrier at a vaporware fan film and its supporters.

One of the big reasons i'm so ardently NOT on their side. They are in the wrong clearly, yet they and their followers are acting like children and bullies.

If they were contrite instead of apoplectic I might take a more neutral position and hope for an amicable resolution.

it isn't that their supporters *are* this, its that Axanar is trying to spin it up rather than losing it by sharing deeper insights with that crowd as to the reasons they are being sued.
