CBS/Paramount sues to stop Axanar

I was just wondering about something. Although we can speculate about this, that and the other... Is Axanar Productions and Ares Studios two legally separate companies?

Also... Kittens Recreate Kirk v Spock

Axanar Productions, Inc., appears to be the sole legal entity producing Axanar. Of course, it would be interesting to know who owns Axanar Productions. The lawsuit identifies Peters as the "principal," but there could be other owners.

Axanar Productions is also the company listed as a signatory to the SAG-AFTRA contract, not Ares Studios, again suggesting they are not separate entities.

Is Axanar licensed by CBS/Paramount?

No, Axanar is an independent project that uses the intellectual property of CBS under the provision that Axanar is totally non-commercial. That means we can never charge for anything featuring their marks or intellectual property and we will never sell the movie, DVD/Blu-ray copies, T-shirts, or anything which uses CBS owned marks or intellectual property.

So why are you making Axanar?

Also, looking at Axanar's website and was blown away by the outstanding qualifications that Alec has

The leader and visionary of the Axanar project, Alec is the epitome of someone who discovers their calling and succeeds in pursuing it. An attorney by training, Alec coached an NCAA Championship volleyball team at USC and with the US National team, then struck off and started five companies earning him an Ernst & Young Entrepreneur of the Year Award in 2003.

So let's see:-

1) Merchandise such as coffee - commercial (mainly for the co-partners)

2) Equipment bought and fitted for future money making uses - commericial

3) A convention - commercial

4) Personal salaries of Peters and his girlfriend - profit. Just what is the girlfriend's job? $10 says it's a bullshit one created by Peters to pay them both enough to totally live on.

Yeah, not for profit my hairy arse....

Apart from it being a working day, what is special about Monday? if it is press release, he has been doing that a good deal on websites

If August is when the lawyers talked to Peters, and I am sure they did, I bet this must have ticked off EPK - supposed "fanfilms" do not need Electronic Press Kits
 
Also, I wonder why he resumé doesn't mention that Propworx, his previous endeavour, went bankrupt.

Do Ernst and Young award him "Bankruptee of the Year" as well? :lol:

Yeah, I already checked that out. Once of my ex-colleagues specialises in media law and is aware of the firm.

He should be able to work this case from vacation in the Bahamas and make a mint while doing it. He probably hasn't seen a slam dunk case like this in his career.

Last time I had jury duty, part of the case turned on whether a cab company and a limo service owned by the same guy were separate entities. What it came down to was that both companies were using the same office, the same computers, the same filing cabinets, etc., the drivers switched between cabs and limos according as need be, and even though each business had a different phone number, in practice they were used interchangeably, with the same person answering both lines. There was so much overlap between the two that even though they were registered as separate companies, they were legally identical.
