CBS/Paramount sues to stop Axanar

Oswriter, In your opinion, how long do it will take for a judge to issue an injunction. Could Cbs try to expedite it?
 
As part of an agreement just reached by Peters, the Prelude's end has a new narration

"Stardate 2245.1 - the CBS lawyers enter the courtroom"
 
There's a popular theory on the fan page that CBS is doing this in order to steal Axanar because they don't actually have anything for the television series next year. One of the commenters agreed, saying that Axanar was Alec's intellectual property, and CBS couldn't touch it.

I wanted to respond to that, to do the equivalent of shaking someone out of a stupor, but then I'd have to join the fan site and they're moderating new members now.

I think that is one of the stupidest things that I've ever heard. Trek is one of the longest running franchises and could attract talent to it to develop a new series. It's given a lot of Hollywood players their start. It could get someone to come up with something. It doesn't have to steal Axanar.
 
I was looking into the background of the lawyers representing Paramount/CBS in this case and found this amusing item from the lead attorney's profile:

Obtained dismissal with prejudice for DreamWorks Animation (DWA) and Paramount Pictures in a copyright infringement suit involving the 2008 animated film Kung Fu Panda. The plaintiff alleged that DWA used his original character sketches and stories as the basis for the 2008 film. The plaintiff dismissed his case with prejudice weeks before trial after Loeb & Loeb uncovered a 1996 Disney coloring book that the plaintiff copied in order to create the panda artwork that was the basis for his lawsuit. (Gordon v. DreamWorks Animation et al)

Somehow, I doubt these guys will be afraid of a bunch of angry Facebook posters.

It was stupid enough that my eyes crossed upon reading it, hence my desire to plead with that person to come to their senses. I mean the argument was essentially "They can't take Alec's IP! He already stole it fair and square from them! That makes it a deadlock!"

I can't offer a reliable estimate, because that depends on the docket of the individual judge. But I assume CBS and Paramount will move for a preliminary injunction within the next couple of weeks. I would assume they'll try to expedite any hearing to ensure a decision before Axanar begins principal photography, which from what I understand is scheduled to begin in February.

I actually just read David A. Goodman's licensed book, "The Autobiography of James T. Kirk," which does briefly discuss the Battle of Axanar. I remember thinking this was going to piss off Peters.

If any of the Axanar crew is reading:

Dear Axanar Crew,

I implore you to get out now, while you still can. There are 20 Doe defendants still to be named and it could be you! There is almost no way Alec can win this case, the odds are stacked against him. While I admire your comradery to your team, and dedication as a Star Trek fan, you need to think of yourself and your family! Is this really worth losing your shirt over? Please consider this situation carefully, as it is very serious. Should Alec somehow succeed, then you can consider rejoining the team at a later date. If I we in Alec's shoes, I would urge you all to leave the team, and shoulder the charges myself. While Captains do go down with there ships, there is no reason the crew needs to remain. Again, think of your families, your livelihood, and your future prospects, is this worth it?

In the complaint, I think this is the key bit:

The Axanar Works are intended to be professional quality productions that, by Defendants’ own admission, unabashedly take Paramount’s and CBS’s intellectual property and aim to “look and feel like a true Star Trek movie.” On information and belief, Defendants have raised over $1 million so far to produce these works, including building out a studio and hiring actors, set designers, and costume designers.

Tom, it's pretty obvious the lawyers know who most of the Doe defendants actually are. I suspect they only named Peters in the complaint--heck, they didn't even name Burnett--because they are clearly trying to give the staff a chance to abandon ship and force the production to shut down.
 
I've often found that egos are associated with some of these fan productions. Rather ironic as they're amateur fan film productions rather than Hollywood productions.

I tend to avoid the personalities although I had to deal with Peters when he got into arguments here. I don't hold grudges though, just figure some get too close to their "babies."

But after reading all of this and his response to same, I have to conclude that either he's even more egotistical than I realized, or he's just batshit crazy. Who would hit back like that when faced with a legal challenge? Paramount/CBS will grind him to a pulp.

It's a pity because this was one of the fan productions that seemed to be decent. Based on a short snippet, of course, but I'd have liked to have seen it.

For any of you doing fan products out there, guys, you're *not* Hollywood professionals. Don't get big-headed. There's enough of that from those who are professionals at times.
