There's a popular theory on the fan page that CBS is doing this in order to steal Axanar because they don't actually have anything for the television series next year. One of the commenters agreed, saying that Axanar was Alec's intellectual property, and CBS couldn't touch it.
I wanted to respond to that, to do the equivalent of shaking someone out of a stupor, but then I'd have to join the fan site and they're moderating new members now.
Obtained dismissal with prejudice for DreamWorks Animation (DWA) and Paramount Pictures in a copyright infringement suit involving the 2008 animated film Kung Fu Panda. The plaintiff alleged that DWA used his original character sketches and stories as the basis for the 2008 film. The plaintiff dismissed his case with prejudice weeks before trial after Loeb & Loeb uncovered a 1996 Disney coloring book that the plaintiff copied in order to create the panda artwork that was the basis for his lawsuit. It was stupid enough that my eyes crossed upon reading it, hence my desire to plead with that person to come to their senses. I mean the argument was essentially "They can't take Alec's IP! He already stole it fair and square from them! I think that is one of the stupidest things that I've ever heard. Trek is one of the longest running franchises and could attract talent to it to develop a new series. It's given a lot of Hollywood players their start. It could get someone to come up with something. It doesn't have to steal Axanar.
Oswriter, In your opinion, how long do it will take for a judge to issue an injunction. Could Cbs try to expedite it?

I would find it funny though, at this point at least, if CBS/Paramount decided to order a novel detailing the Battle of Axanar through their contracts with Pocket Books/Simon & Schuster.

Fact of the matter is that plenty of people and firms have already profited from Mr. Peters' little adventure. He himself has taken a salary, he and his pretty china doll wife have gone to numerous conventions on the Axanar dime, many people have been paid from the Axanar funds, and, oh yes, more than $100,000 of this was used to build a set for Mr. Peters' Ares production house.
I am concerned with many of the senior staff who are really good guys (like Terry) that want to stick in there with Alec, during the lawsuit.

Dear Axanar Crew,
I implore you to get out now, while you still can. There are 20 Doe defendants still to be named and it could be you! There is almost no way Alec can win this case, the odds are stacked against him. While I admire you comradery to your team, and dedication as a Star Trek fan, you need to think of yourself and you family! Is this really losing your shirt over? Please consider this situation carefully as it is very serious. Should Alec somehow succeed, then you can consider rejoining the team at a later date. If I we in Alec's shoes I would urge you all to leave the team, and shoulder the charges myself. While Captains do go down with there ships, there is no reason the crew needs to remain. Again, think of your families and your livelihood and your future prospects, is this worth it?

The Axanar Works are intended to be professional quality productions that, by Defendants’ own admission, unabashedly take Paramount’s and CBS’s intellectual property and aim to “look and feel like a true Star Trek movie.” On information and belief, Defendants have raised over $1 million so far to produce these works, including building out a studio and hiring actors, set designers, and costume designers.
