Why there can't be a proper live action Batman TV series

Honestly knowing the way WB's fractious internal structure operates, it's way more likely that if there's any legal "block" involved it'd be coming from one of it's own divisions, not some outside entity.
 
Frankly T.V rights don't mean as much in this age of streaming. HBO max is where the new Batman spinoff series will be anyway, so Disney can clutch onto their T.V rights all they want. Within a few decades, the T.V rights won't be worth squat.

They very much still do though, contrary to popular belief. TV rights and streaming rights are negotiated separately , and there are some parts of the world where broadcast is still dominant, where high-speed internet is a luxury, where streaming simply isn't reliable enough, through no fault of their own.

Plus some streaming apps in some places just plain suck and require workarounds just to be able to use them. Case in point, I've been trying use an app put out by one of our big networks here, and because it's not supported on the hardware I use on my TV, I have to mirror my phone screen to the TV, which is a suboptimal solution. On top of that, the mobile app lacks many features found on other apps such as favourites. Everytime I want to watch an ongoing series on it, I have to physically search for it. The reality is that some places still struggle with streaming even its basic forms.
