Ditto the writer who said they're not allowed to use anything from any of the movies. I agree with those saying the 25% different thing was to be able to sell mew Enterprise merch.Some time ago John Eaves made a post on facebook, claiming that the Enterprise on Discovery had to look 25% different from the TOS one for legal reasons, (a post which he later deleted, which lead to speculation on wether CBS forced him to delete it, to keep the public from the truth or whatever). Since DSC has since used actual footage from The Cage, I don't think anyone still seriously says the 25% ting. At least I hope.
So someone is making ship toys. But it doesn't really matter how many companies do it now, if someone wants to do an Enterprise collection down the line having an additional design benefits CBS.Problem is, apart from Eaglemoss producing models, nobody makes any Trek ship toys.

Today CBS provided TrekMovie with the following statement to clarify the design decisions:
CBS TV Studios does, in fact, have the right to use the U.S.S. Enterprise ship design from the past TV series, and are not legally required to make changes. The changes in the ship design were creative ones, made to utilize 2018’s VFX technology.
The art that was used in the 2019 calendar is ‘concept art,’ which was completed long before the VFX process is completed.

While I'm leaning towards her being misinformed (and thus the writing potentially suffering as a result), it could also be that those references were snuck in under the radar, akin to the novelverse's myriad Kelvin universe references (icy Delta Vega, Tattooed bald Romulans, Red Matter even though they don't call it that) while they explicitly didn't have the rights to feature Kelvin stuff.
