The name 'iPad' is already trademarked... I smell a court battle...

Top New Zealand architect Andre Hodgskin created a sensation when he launched the BACHKIT™ in 2000, gaining acclaim in international design magazines. Andre has now developed – the iPAD™ – a fresh look at the concept of a simple but stylish lightweight kitset building.
The iPAD™ is a true kitset bach designed to covers a range of options; it could be a one bedroom holiday home, secondary dwelling, granny flat, office, studio or resort unit to name but a few.
It can be grouped as a series of pavilions to form larger accommodation if required. A single iPAD™ totals 50m sq with decks of 55m sq and will retail in New Zealand for $125,000.00*. Various external cladding and colour options are available to suit individual taste and context.

No doubt Apple will soon go batshit crazy over this guy for trade-marking the name years before Apple used it.

Unless it all comes down to spelling - iPAD vs iPad...?

...didn't stop the iPhone (Cisco). Apple even had the gall to go after the pre-existing "Pod" trademark after they came out with their ipod.

I'm not greatly versed on these laws, but I suspect that since the original "iPad" and the Apple iPad are two very different things there's no conflict between the two sharing the same name.

A trademark in New Zealand is not a trademark in the United States. If they did not trademark the name in the US, it is open for whomever does. Also, given Apple's use of the i*** type of name over the last dozen years (iMac, iPod, iPhone...) and this company did not start to use that name until after 2000 when it was called BACHKIT, thusly after the launches of iMac and iPod, who is trading on who here? Apple has a reputation for style and innovation. What better image to leech from if you are an architect and are looking to sell your idea of a 21st century prefabricated dwelling? They called it iPad to insinuate that if Apple were to build a pre-fab, this is what it would be. And that, in and of itself, could give Apple the claim they never should have been given the trademark for the name as it should rightfully be theirs. Just as McDonald's challenges any use of the "Mc" prefix.

Because Cisco and Apple reached a settlement, it wasn't like Apple just got to ignore the other product.

Anyway, the thing the thread is about isn't an issue. This, however, is. There's already two products being sold under the iPad name. Apple will probably settle somehow again, but you think they'd have thought of this ahead of time...

My memory is a bit hazy on this, but it's a different scenario. The Federation had a deal with the Fund, they broke the deal.

Though... much like the McMahons were an easy target, anyone would be an easy target for Apple.
