Terry Nation didn't create Davros ...

If the guy actually created Davros then I hope he gets some money out of it. End of story.

But he clearly didn't,and shouldn't. The image in question is clearly a drawing of Davros, a character on Dr Who. People involved in the creative process of a TV show tend to be, you know, creative; and not prone to plagiarism.

My suspicion is that this is the end result of a bet or dare made down the local.

It's amazing the way he managed to include Davros microphone despite that fact that it was only added during shooting to allow Michael Wisher's voice to be modulated live.

My only hope is that the BBC don't decide to settle this out of court to save time/money. That's a false economy, from just a few fans here it's clear that there are a whole heap of unanswered questions about the 'original' drawing...
 
Has anyone heard of the term 'statute-barred'? In the UK, you have 3 years to issue proceedings (6 years in a breach of contract case) or, if your cause of action arose when you were a child, three years from the date of attaining your majority (ie until you're 21).

This time can be extended in a personal injuries case or if you only learn of your cause of action at a later time.

The time has long since elapsed in this man's case. This case is going nowhere.

Yeah, I would assume the SoL is blown, but there is the argument to be made that it is an ongoing infringement and not a one-time thing. You could make the argument that the injury occurred the last time Davros appeared and will occur again the next time.

Oh, snap! Maybe this will greatly discourage and even delay considerably the next "Obligatory Appearance Of The Daleks (NOW THEY ARE WORSE THAN EVER!! ZOMG!!)" episode. At the very least it will be a long, long, looooong time before we see Davros. At least until this gets settled one way or another.

I think if this thing goes to court they should enlist some fans as expert witnesses, obviously we have some salient points to raise (well, I don't, but others seem to! :lol:)
 
They should have someone give testimony as Davros, with the voice modulator and everything. That would be amusing.
 
That's only the judge and the lawyers, witnesses and the accusued don't have to...though there's a potentially amusing comedy sketch in that idea if you ask me!

ROTFLMAO. In fact the whole thing should be done in Who costume. The judge and barristers etc should be dressed as the high council f'rinstance. :lol:
