I seriously hope that a medical officer aboard a ship does kill someone in order to save 300 of his shipmates and to prevent the assassination of a President and to prevent war, oath or not.

Exactly. Especially since it's his job to protect the well being of the people on the Enterprise, not to mention preventing a war. The situation in "The Empath" is much different. That was him not allowing an innocent to die to save himself. This is combat with the lives of his crew in immeadiate danger while they're defending the Federation.

If he absolutely had to, yeah. But he certainly wouldn't have been so cheerful and jokey about it as he was shown to be. He would've done it with great reluctance and a heavy heart. And he wouldn't have volunteered for it unless it were absolutely necessary that he be the one to do it -- which it wasn't.
