Something weird in Khan #5

I don't have the full issue, but I saw this page from the preview on startrek.com.

The guy in the cryotube. He can't possibly be Malik from the ENT season 4 Augment arc, can he?????????

They probably just meant it as an easter egg and forgot that Malik and his group of Augments weren't actually on the Botany Bay. No big deal.
 
Or that they weren't even born until at least 140 years after the Eugenics Wars. Somebody didn't dig deep enough in their research.
 
Or the tubes Dr. Soong cloned them from were copies, i.e. it's Malik #1 in the tube, and his copy (Malik #2) went down in the 22nd century.
 
I kept expecting Soong to reveal that Malik was a young clone of Khan during the Augment Arc, so I guess we can say the Malik from ENT was a clone of this guy.

But yeah, reeks of Did Not Do Research™.
 
Thinking things over, it is odd they featured Malik as opposed to someone from Space Seed or TWOK, like Joaquin. Even Joachim would have made more sense than Malik. Or are they featured elsewhere in the comic? I haven't actually read the Khan series.
