TRENTON, N.J. - A 14-year-old New Jersey girl has been accused of child pornography after posting nearly 30 explicit nude pictures of herself on MySpace.com — charges that could force her to register as a sex offender if convicted.

While one could argue that sex-offender laws need to be modified, one could also argue that posting nude pics of yourself online when you're underage is asking for trouble. Stupid kids...
 
This case is a little more clear cut than some (this girl = dumb) but the fact remains that the issue is becoming more and more difficult to figure out every day.

There are 15 year olds getting in trouble for showing pictures to other 15 year olds, which is bad because after enough of that and they'll start watering down the punishments, thus letting the real creeps off easy.

They need to start making the laws more specific so there are mechanisms to deal with this kind of thing that don't let the real bad guys off the hook.

Yep.

And that's the problem. Do these kids deserve punishment for putting jailbait online? Sure thing. Do they deserve the same punishment as a 45 year old man? Of course not.

So once you have enough 14 year old girls getting ridiculous punishments, the legislature is going to swing into action to stop it. Let's hope they do it by writing entirely new laws that take this kind of thing into account instead of just poking loopholes into the old laws for 'special cases.'

Because that's when other people start taking advantage of those loopholes.

OK, in fairness, there are pictures floating around that are decades old, so is the now 40 something unrecognisable person being harmed or exploited? But it's illegal because it's illegal to post or possess nude photos of underage persons, period.

The circulation of these pictures in itself is thought to be harmfull because it also creates more demand, and makes the demanders feel that it's "OK" and "harmless" and if it's just a basic nude then no one is being hurt.

The laws against child porn are also to address demand and consumption and distribution of child porn, not just production.

In this case, this is a good example of why we have trials and juries and discretionary sentences. "Could force her to register as a sex offender if convicted" is the key phrase here.

Doesn't matter. Nudes of adolescents and teenagers are pretty much universally considered child porn. They don't have to be of an explicitly sexual nature.

It's even questionable to have pictures of your toddler taking a bath anymore. Some people are so reactionary.
 
I do know a guy who has to register because he slept with a girl that he didn't know wasn't 18 yet. He wants to change the laws because he thinks they're unfair. I think he should have checked the girl's I.D.

If she looks too young, err on the side of caution and tell her you just want to be friends. There's plenty of women who are both quite legal and willing to help you get your willy wet. There's no reason to take such an unnecessary risk.
