Samsung to Apple: "Show us the iPhone 5"

[A poster on this site] points out that Samsung has filed a motion Friday night asking Apple to turn over the iPhone 5 and iPad 3 as part of the discovery process in the ongoing Samsung/Apple legal feud.
Samsung claims that it needs to see Apples future products because devices like the Droid Charge and Galaxy Tab 10.1 will presumably be in the market at the same time as the iPhone 5 and iPad 3, and Samsungs lawyers want to evaluate any possible similarities so they can prepare for further potential legal action from Apple.

Right, so... somehow I can't see this happening.
 
Apple was able to successfully file for Samsung to release their unreleased products to the court. This is obviously just legal positioning on Samsung's part though.

The core of this case is that Apple is essentially claiming that Samsung is producing products that are intentionally designed to confuse people into think that they are Apple's products (a Trade Dress suit). I'd suspect that Samsung's point here is that the design motifs in question are sufficiently generic that they would have to go out of their way to not look similar to Apple's products.

Well, if Apple got to see Samsung's new products....then I don't see why the opposite shouldn't apply.

If Apple is going to sue them over future products (which is what your first sentence implies), then they ought to be able to be allowed to prepare a case by making the comparison themselves.
 
Samsung is full of shit. Apple has no obligation to show their trade secrets to a competitor.

You may have missed the whole "Apple was able to successfully file for Samsung to release their unreleased products to the court" thing earlier stated by Arrgh. Sauce for the goose.
 
It's worth point out as well that both sides would only see their lawyers with access to the products in question for the purposes of examining them in a patent dispute suit. It's not like either Apple or Samsung is trying to get their competitors devices into their own labs. It's all about leverage and maneuvering for the lawsuit, not a grab for trade secrets.

Besides, Samsung is one of the major suppliers for Apple and actually fabricates the chips in the iPads. It's not like they don't already know what they're made of :p

Samsung galaxy s2 is far away better that iphone 4, hope everyone agrees with that...so no matter how many iphones is discussed online these days...facts is facts:)

Sorry. "far away better," is, by definition, an opinion, not a fact. Even if it's true. The Samsung s2 has specific features that the iPad might or not have. That is a fact, unless you know it to be false. But as soon as you add a value judgement, like worse or better, or difficult or easy, you've added your opinion.

I'm going to be a defense attorney and a prosecutor. That way, I can roll in the cash as I argue with myself and bill everyone involved. :D
