Romulan Ale is illegal

what if the "Romulan Ale" is not made in Romulan space? After all not all Vodka is made in Russia, or Scotch in Scotland.
 
The usage of the brand name "Romulan Ale" certainly wouldn't depend on the laws or sensibilities of the Romulans. Nobody would ask them, or listen to them whine about copyright.

But if the UFP wanted to ban Romulan ale because it was wrong to fraternize with the enemy, then surely the UFP would also ban the use of the name "Romulan Ale" for any UFP product. And there wouldn't be any point in selling the stuff under any other name.

to be called Scotch it must be distilled in a Scottish distillery.

And to be called champagne it has to come from Champagne. Doesn't stop a lot of brands from making "champagne." As I said earlier, I'm going to guess that some Federation citizens (or maybe the Ferengi) figured out the recipe and started selling "romulan" ale.
 
The replicators aboard the USS Enterprise-D were not capable of replicating Romulan ale. It would require programming the devices with the molecular structure of the beverage. The recipe was not readily available due to the lack of communication and information between the Federation and the Romulan Empire. (TNG: "The Defector")
 
That recipe requires, I dunno, something not alcohol.

I'll have a Romulan Lemonade, please.
