It is entirely plausible that Orci will get a "story by" credit, even he doesn't get a "written by" credit. (He may very well get both, even with multiple rewrites without his direct input, of course.)

The comment in question was as cryptic as Elizabeth Warren's Shermanesque pledges, and for the same reason. He said he's producing, present tense. Even including "nothing more or less," that present tense could mean he's no longer polishing his existing script, though they might still use it. Nothing seems conclusive to me, one way or another.

Yes, he was on record as co-writing with Patrick McKay and John D. Payne.
