New York State Unemployment

This is posted on behalf of a friend. Maybe someone knows the answer... let me state I'm just a messenger here.


"I was on unemployment, and I took a job. Job lasted eight weeks, I was fired when I was confronted with a task I could not comprehend or complete in a satisfactory manor. I never informed Unemployment I took this job I simply stopped claiming. As I understand it I can resume claiming on my existing claim? Or am I in fact done with Unemployment benefits because I was fired? Calls to NYS Unemployment have gone unanswered."

Lawyers are not the answer, suing people not the answer just looking for an answer to the benefits question.
 
Kinda of a tight spot: 1) they [the unemployment office] could get seriously bitchy cause he didn't report the job-- expect the word "Fraud" tossed around even if he didn't take any money. Which could impact him getting his benefits back 2) He could probably draw even if fired for cause (it isn't as black and white anymore as people think, it's really up to the case worker for the most part and whether or not you can sell them that even thought it was for cause ti wasn't your fault).

Of the two things though, not reporting is going to cause his biggest headache, I would think. And will be the biggest barrier to him restarting his claim.
 
AFAIK once they tookthe new job their benefits from being laid off from the old one ended. As for getting benefits for losing the replacement job? Depends on the rules in each state. I have no idea how the laws in NY are when it comes to being fired for this.
 
You can still collect because it is a separate claim. Once that claim runs out then you are toast. This hiccup won't effect the already existing claim.
 
I just did a quick glance at the NY Unemployment site:

(ii.) "Reopened claim" means a subsequent claim in which the lapse was for reasons other than employment.

So if they find out he had a another job, they probably won't reopen the claim.

But it doesn't look like they're as hardass as TN is:

Q: What should I do when I return to work?

A: When you get a job, you should claim credit for the last days you were out of work in the usual method (by telephone, mail, or online), then simply stop claiming your weekly benefits. Do not claim benefits for any week when you work more than three days or earn more than the maximum benefit rate (currently $405).
