My paycheck bounced.

If they pay you overtime, you are non-exempt, therefore they can dock you if you don't work 40 hours.

Also, even if you are exempt, you can be docked if you aren't actually present and working for 40 hours a week. If you are absent for one of various reasons, it is perfectly legal to dock you.


They are only paying me straight time past 40 not time and a half like the plant employees make(I'm office) time and a half only kicks in if I break 50 hours.

Okay, I think I misread your original post. That does not sound legal. Overtime is overtime. If you are working more than 40 hours and are non-exempt, you are entitled to time-and-a-half pay. It sounds like they are trying to have it both ways.

You should ask your employer if you are considered exempt or not. If not, ask why they are paying you straight time when you work over 40 hours. You might ask your state's labor standards board, too--I believe every state has one.

I'm a computer drafter so per USC 29-8-207 and 213 I should not be exempt right? I think I'll be making a call to the labor board on Friday since I work four 10 hour days:bolian:
 
Yeah, it sounds to me like you are not exempt. In any case, they wouldn't have to pay you overtime at all if you were, so the fact that they do indicates they at least think you are non-exempt.

I'm not going to give em hell for the simple reason that I've worked all of five hours overtime in the two years I've worked here and it's not worth potentially losing my job over. My coworker however should have several thousand dollars over four years due him. Thanks for the help.

I just got a letter in the mail from Job That Issues Bad Checks.

$500 check and a letter explaining their desire that I don't talk to investigators about this incident.

Seems my CUTBACKS have lead to SUPPRESSION OF FUCKERY... but I'm wondering if I don't speak out about this will it be considered TREACHERY? Either way it's pure BS.

Don't talk to investigators? Yeah, that would make me want to go running right to investigators and sell their butts out.
 
If you don't need it, send the check back with a note that your integrity is not for sale.

Nah. Cash the check, demand more money to keep you from going to the investigators, then go to them anyway! ;)
 
This reminds of what happened in my job earlier this year. My company which does security for major US Airlines (don't want to say which in case of identification because you guys know them) didn't pay me and some others our monthly wage. We had to wait for it to come next come. I was excited by the prospect of getting two months salary in one month....... I for got about the tax. :rolleyes: I was kind of pissed especially when I found out that most of my fellow colleague got paid the next week and were told to keep it a secret. All of them were of the same ethnic group has the managers.

Then a few months later it I accidentally overheard that they forgot to pay a white guy his wage and he didn't mention it so they decided not to pay his second months wage until they were sure he ran out of transport money.


Oh and there was a company that did the same job has us but for a different Asian airline. They never paid any of their staff for 3 months. The only time they paid them was when the DfT (a UK government Agency responsible for Airport security) came over. They paid for one month and then didn't pay them next month. Eventually all the workers went on strike which nearly ruined the company.
