The remake is needed because Sony doesn't want to lose the rights to the character. That's really the only reason why anyone would want to do a reboot this soon.

Jesse Eisenberg is already filling that role. More like Lerman is the poor man's Jesse Eisenberg.
The only thing that is holding me back from completely embracing this project is the reports that they want to make it a gritty, angst ridden high school drama or whatever. Spider-Man is not Batman.
If Lerman doesn't get it, I hope they give it to Johnny Simmons. His biggest call to fame has been Jennifer's Body, but he has been recently in a really good character drama called The Greatest and he really impressed me with his acting abilities in that film. Since he's one of the actors supposedly in the running, I wouldn't mind if he nabbed the role.
I still Spencer Treat Clark from the suprisingly good "Last House on The Left" remake of last year should be Spider-Man/Parker.
Anyone with concerns about his acting chops should see the remake of 3:10 to Yuma with Russell Crowe and Christian Bale. He plays Bale's embittered elder son - very memorably.
Would they lose the rights if they continued with movies starring Maguire, with Spidey being in his 30's?
It's partly about rights and partly because I think the previous movie, while it made money, was pretty much a critical failure among fans and if you watch the thing you can see the flaws in it where Rami pretty much stopped caring. (The Exposition News Channel is a great example.)
More so, I think McQuire -mostly probably due to his back injuries- isn't much interested in doing anymore of them and all three movies have been criticized for a few elements (probably most notable in Dunst.)
It's probably a little "early" to "reboot" this movie franchise (the first movie only came out around 10 years ago) but if Sony has to make a new one to keep the franchise rights then, well, I guess we'll get another movie. It'll be interesting to see a new take on the character and to see how it'd look if not done so colorful and gleeful (one of my criticisms of the Rami movies.)
I doubt the studio gave a gnat's wing about the critical reception--not when domestic gross did as well as it did. They're rebooting simply because Raimi didn't want to do what the studio wanted him to do, so rather than keep the continuity without the man, they're taking the opportunity to start from scratch and jam everything trendy in there that they can.

Well I think going back to HS for Spidey would be alright - especially since it seems like Marvel's movies are kind of taking notes from the Ultimate universe anyway... and Pete's still in High School there. They really didn't do a whole hell of a lot with his high school years really. Basically it was "Hi I'm Peter Parker, high school photo geek... hey I got bit. Now I'm Spider-Man. Then... Hey I'm graduated yippee! I'm gonna be roomies with Harry! Oh Norman's a dick. Norman's dead and Harry's pissed at "bad ol' Spidey" Oh well... off to College classes!"

I think the biggest reason for a reboot was that Sony wanted a director that they could control better. It didn't help that Spider-man 3 sucked and the budget was getting out of hand. Rebooting means that they can keep the costs down since they don't have to rehire the original actors.

No, but as far as I remember Maguire won't do it if Sam Raimi isn't involved, and Raimi doesn't want to do another film if Sony don't give him the creative control he wants. (and they won't, for some reason)
Strange how when he had creative control, we got the first 2 movies. And when he didn't, we got the third.

And since the comics started off with Peter in high school that seems like a good place to start with me. Just as long as they don't really try it into another Twilight, one is more than enough.

I know it's unrealistic and unlikely but if I was Disney/Marvel I would throw gallons of money at Sony to get the rights back and do the next film properly. Frankly I am not enthusiastic about this film based on the low budget, the director chosen and the shenanigans behind trying to make it. At least use the infamous Disney lawyers to throw wrenches to keep Sony from making the film long enough to get the rights reverted. I mean isn't Spider-Man supposed to be Marvel's flagship character? Marvel has show with their recent movies and plans that they know how to pull it off.
