Data would best any version of Khan in physical strength and mental ability, but it is likely that Data would not be able to ruthlessly sacrifice others to achieve victory, so there is a way that Khan could "win", but even then it would be a narrow victory

Technically he was beat by Spock. He surrendered to Kirk on realizing his people were on Enterprise and he now had a way to get at Admiral Marcus through Kirk.

Even more technically Spock said he did what Kirk would have done, so Kirk beat him through Spock

It's almost comical how Spock does all the significant stuff in both the nuMovies so far, and Kirk gets all the glory... It's probably a combination of Spock being too damn Vulcan and Kirk always managing to save the bacon of somebody who is in a position to put a good word in for him.

Except Pike, who bought the farm while Kirk was wrestling with a hose while Khan was plugging everybody in the building. Without Pike, Kirk won't be seeing Admiral anytime soon.
