It seems there is a reason for the visual reboot and the producers aren't being honest about it.

Someone in that thread asked a good question...if Paramount couldn't use the TOS Enterprise, and CBS can't use the TOS Enterprise...who the hell does have the right to use it?

I wonder if this is why we won't be seeing a adult Spock on the show?. How long until Sarek is renamed Sarec or the Klingons become the Clingions and the Vulcans become the Vulecians. "Live Long and Prosper" all of sudden is "Long Life and Success." No wonder "Orville" will never be sued. Can't sue people for something you don't even own anymore!

It this legal in the sense they can't use it, or don't want to pay the estates of various creators from TOS?

I'll wait for someone from CBS Legal to chime in, as opposed to the artists.
 
Orville isn't sued because it isn't breaking any laws.

I know. I was making a little joke about some of the stuff people talked about before in regards to the show. Still I wonder who owns all the Berman era stuff? I guess we do all own "Midnights Edge" a apology because they did talk about this stuff a very long time ago and everyone scoffed at them.

This doesn't make a lot of sense, honestly. They can use the arrowhead, but not the Enterprise? They can use the Klingon symbol, but not the D-7? They can use Vulcans, but not the Andorian or Tellarites?

It definitely sounds more like this is about paying rights fees to certain creators than whether or not they own the elements.

Maybe @Maurice could chime in?
 
Perhaps there is difference between how important something was to the older shows. Spock and the old Enterprise can't show up but Pike who was in the pilot and reused footage later wasn't important enough to the success of the old show and thus he can be used if people want to use him. You got to change the Klingons because they are going to be series regulars. The Vulcans on the other hand don't have a series regular on "Discovery" since Sarek was only in a few episodes. You can keep the old look.

Am I the only one not surprised that the production team isn't revealing "everything" about the BTS legality and rights discussion to the audience?

I mean, it's baffling and confusing as it is but I don't usually watch my TV show BTS info for the legal speak.

If it is driving the creative decisions, then the legal stuff is every bit as important as the writing and art direction.

Not saying it isn't important, but it is rarely revealed so I'm not surprised that the production team isn't sharing all of it.
 
Did something change in between "In a Mirror, Darkly" and now? Back then, ENT got away with using the TOS look for the Defiant...
 
Is there anything more iconic where Star Trek is concerned than the Starfleet arrowhead?

I wouldn't consider them super important. I would think terms like Starfleet and the Federation would be bigger deals but maybe they are seen as generic concepts like the transporters or phasers that feel universal to the whole concept of "Trek" that no one company can own just those things. Plus the arrowhead didn't really become important until the "TOS" movies since on "TOS" the Enterprise crew where the only ones to use them.

I wonder who owns the music rights? We have heard fragments of the old "TOS" theme but I don't think they have ever used the whole thing.
