In Defense of Commander Michael Burnham

In regards to Commander Michael Burnham, First Officer, U.S.S. Shenzhou, NCC - 1227

A formal rebuttal against the judiciary panels determination that presided against Commander Michael Burnham's case of mutiny.

Commander Burnham was sentenced to life in prison for mutiny aboard that the U.S.S. Shenzhou after she made contact with a unknown alien object that was later discovered to be Klingon in origin. During her investigation of the object she encountered the Klingon Torchbearer that she killed and the Klingon's used as the reason to launch their war against the Federation. After suffering radiation damage rendering her unconscious, Commander Burnham was rescued by the U.S.S. Shenzhou. She then committed an act of supposed mutiny.

Based on Starfleet General Orders however Commander Michael Burnham acted accordingly and within Starfleet regulations.

Article 14, Section 31: The exact language has never been cited, but certain lines in this section permitted the use of "extraordinary measures" in times of dire emergency. Regarding Commander Burnhams use of her suit in an to attempt to flee the Klingon Torchbearer is considered holding true to Article 14, Section 31 as she used "extraordinary measures" her suit in times of dire emergency. The dire emergency being that the life support of her suit was nearly extinguished along with not having contact with U.S.S. Shenzhou due to the Klingon Object's field that blocked communication between Commander Burnham and the U.S.S. Shenzhou so that Captain Georgiou could instruct Commander Burnham further, Commander Burnham did exhibit control over the situation in attempting to leave the hostile area without engaging in combat with a known hostile force considered to be extreme at least.

For this act Commander Michael Burnham should receive a Meritorious Commendation.

General Order 12: "On the approach of any vessel, when communications have not been established..." the ship was would to go to red alert when faced with a non-communicative ship.

The suit that Commander Michael Burnham was in is in fact considered a vessel as it provided for her the life support measures necessary to survive in a hostile environment that would otherwise not be considered to provide life support based on her own natural bodily functions to provide said life support to keep her alive.

Commander Burnham did in fact follow General Order 12 to the letter when she used her space suit as any Captain would use their starship to ensure the safety of the crew contained within it when she fired the suits thrusters in an attempt to flee the attacks of the Klingon Torchbearer without causing loss of life to either the Klingon or herself.

Seeing as how she had already been attacked by the Klingon Torchbearer and that her space suit is a vessel classified with a Starfleet registration number Commander Burnham did in fact exhibit all general orders mentioned above as she, Commander Burnham and her space suit, were an attached element of the U.S.S. Shenzhou that had come under direct attack by a known hostile force, putting the U.S.S. Shenzhou under the same Red Alert status as Commander Burnham. As such Commander Burnham did precisely execute her judgment in relieving Captain Philippa Georgiou of her command of the U.S.S. Shenzhou to ensure that articles Article 14, Section 31;General Order 12; and Regulation 3 (Paragraph 12) were followed so that the lives aboard the U.S.S. Shenzhou were made safe. It is also a fact apparent that Captain Shenzhou nor any of the other bridge officers aboard the U.S.S. Shenzhou did not retrieve the data from Commander Burnham's space suit to collaborate her findings and her reasoning for rendering Captain Georgiou unconscious and then assuming command of the U.S.S. Shenzhou to ensure life aboard the starship was preserved by any justifiable means, but merely dismissed her claims of Klingon's attacking her due to her injuries. As such Captain Philippa Georgiou and the rest of the bridge of the U.S.S. Shenzhou did not follow Starfleet Regulations in determining the situation and that Commander Michael Burnham did in fact follow, to the letter, all Starfleet protocol.

The panel that assigned Commander Michael Burnham to life in prison for mutiny also did not discharge their judicial duties based on Starfleet judiciary standards in determining a precise course of action in determining Commander Michael Burnham's fate. As such their failure to discharge their duties as Starfleet Officers that they be removed from any judiciary panels in determining the fate of Starfleet Officers in criminal cases and as a punishment be reduced in rank to the rank of Ensign.

As such Michael Burnham's life sentence as a prisoner for mutiny should be commuted at once and that Michael Burnham be restored to the rank of Commander that would entail the full rights and privileges of said rank along with her record of the acts recorded at the Battle of the Binary Stars reflecting the traditions of Starfleet and the officers of Starfleet with the highest regards and admiration in the protection of her crew, her ship and the interests of the United Federation of Planets.

Based on ships logs in the Captain's quarters where a discussion between Captain Georgiou and Commander Burnham took place, the continued persecution of Commander Burnham as being at fault for the Federation being at war with the Klingon's when it was the Klingon's who instigated war, that the morale of Federation's fighting units and non-military science units will continue to falter during a time when the protocols and regulations of Starfleet were maintained without question by Commander Michael Burnham that would otherwise rally the spirit and soul of Starfleet to survive and carry the day against the Klingon's.

In regards to the bridge crew of the U.S.S. Shenzhou who may encounter Commander Burnham in the future that their own mutinous acts against Commander Burnham during a time of war should be stricken from the record as such and that new a respect be found by them for the abilities of Commander Michael Burnham.

Oh my cock, yes we get it Michael's punishment was out of proportion. Plenty of people have been saying that since the premiere ended with that silly shadowy tribunal. But no, by all means pretend you're a lawyer within a fictional universe.

This is the same universe where a captain can admit in his official report to murdering his crew and be given command of the fleet's most important asset with virtual carte blanche. In real life such an officer would be stripped of rank and executed. In light of this, Michael's punishment is ridiculously extreme considering all she really did was pinch her CO on the neck.

Besides, the Federation has no death penalty, except for people who visit Talos IV.
 
What always got me, wouldn't the fact that visiting the planet is the only crime the Federation executes people over make the planet a priority for the intelligence services of the quadrant's other powers to learn as much as they can about?
 
I still, to this day, wonder what was so horrible about Talos IV that even visiting it warranted death?

Couldn't take the risk that the Talosians' power of illusion could be learned by anyone else. That power destroyed Talos, it can (and will) destroy any other race that learns the same power.

And there's also the risk that the Talosians could use any race that visited their world as a "proxy" by which they could wreak havoc on the rest of the galaxy.

Her suit was a registered vessel. Registered to Woolworth's clothing department - active wear? For those occasions when a simple blue jumpsuit won't do we have the space suit onesie complete with a multi-use thruster pack for quick getaways and enemy kills.

Shenzhou to ensure that articles Article 14, Section 31;General Order 12; and Regulation 3 (Paragraph 12) were followed so that the lives aboard the U.S.S. Shenzhou were made safe. It is also a fact apparent that Captain Shenzhou nor any of the other bridge officers aboard the U.S.S. Shenzhou did not retrieve the data from Commander Burnham's space suit to collaborate her findings and her reasoning for rendering Captain Georgiou unconscious and then assuming command of the U.S.S. Shenzhou to ensure life aboard the starship was preserved by any justifiable means, but merely dismissed her claims of Klingon's attacking her due to her injuries. As such Captain Philippa Georgiou and the rest of the bridge of the U.S.S. Shenzhou did not follow Starfleet Regulations in determining the situation and that Commander Michael Burnham did in fact follow, to the letter, all Starfleet protocol.

The panel that assigned Commander Michael Burnham to life in prison for mutiny also did not discharge their judicial duties based on Starfleet judiciary standards in determining a precise course of action in determining Commander Michael Burnham's fate. As such their failure to discharge their duties as Starfleet Officers that they be removed from any judiciary panels in determining the fate of Starfleet Officers in criminal cases and as a punishment be reduced in rank to the rank of Ensign.

As such Michael Burnham's life sentence as a prisoner for mutiny should be commuted at once and that Michael Burnham be restored to the rank of Commander that would entail the full rights and privileges of said rank along with her record of the acts recorded at the Battle of the Binary Stars reflecting the traditions of Starfleet and the officers of Starfleet with the highest regards and admiration in the protection of her crew, her ship and the interests of the United Federation of Planets.

Based on ships logs in the Captain's quarters where a discussion between Captain Georgiou and Commander Burnham took place, the continued persecution of Commander Burnham as being at fault for the Federation being at war with the Klingon's when it was the Klingon's who instigated war, that the morale of Federation's fighting units and non-military science units will continue to falter during a time when the protocols and regulations of Starfleet were maintained without question by Commander Michael Burnham that would otherwise rally the spirit and soul of Starfleet to survive and carry the day against the Klingon's.

In regards to the bridge crew of the U.S.S. Shenzhou who may encounter Commander Burnham in the future that their own mutinous acts against Commander Burnham during a time of war should be stricken from the record as such and that new a respect be found by them for the abilities of Commander Michael Burnham.

What the OP said might be all well and good and perhaps Burnham could have offered up that as defense evidence but as she pleaded guilty to the charge of mutiny the point is rather mute.
 
I'm pretty sure this was brought up in another thread, but in The Tholian Web (TOS), it's mentioned that there's no record of mutiny in Starfleet. Since the Defiant is a significant plot point in Discovery and the writers know what kind of fans we are, they must have expected us to rewatch the TOS episode. The showrunners say everything will work out with existing canon, so either the mutiny conviction will be overturned/expunged at some point, or there'll be some timeline goofiness and this whole season will have never happened. First option seems much more likely IMO, why bother otherwise?

Oh, definitely not, but I still think it might be expunged or overturned for some reason before TOS takes place. I went back and checked the scene in The Tholian Web, Spock's language could give the DIS writers a little bit of wiggle room with canon.

There's "no record" of mutiny, so maybe a) there really is no official record of it anymore, b) Spock's lying because he doesn't want to talk about his mutineer adopted sister, c) timeline tomfoolery happens somehow, or d) the writers of Discovery aren't quite as nitpicky as I am :p

I think it would be fantastic if the writers used a TOS scene as a cross-series easter egg, but Push The Button has a pretty good point. Maybe Starfleet is just terrible at keeping track of paperwork?
