I don't think copyright lawyers care about what is and isn't canon. TAS is copyrighted, that's all. Not being in canon doesn't make it less so.

I can hear the legal firm's conversations. Ok, who here is a Star Trek expert? Ok, no one? Spend the next week watching every episode and film and give us a report.

All I can say is that many of the Axanar supporters are really delusional. It's like they have no grasp of reality.

The hardcore ones are, that's for sure. Most of the Axanar supporters are likely just dismayed and hopeful that a good outcome will still happen for Peters (it won't).
