Honestly, I have no clue if my case would be legit at all, though I do have the original Photoshop files on file, and the fact that the shirt image and mine ARE THE EXACT SAME. I can even point out the parts where I fucked up. But as you can see, this was made before I started putting copyright stamps on my digital images. Plus, he's in a different country. WHAT CAN I DO TO MAKE THIS BITCH BLEED?!?!?!?!

Contact eBay with your case and evidence and see if they'll pull the auction. They've done that kind of thing before over intellectual property issues.

Luckily for you, and all other artists out there including myself, you don't have to put copyright stamps on your stuff in order for it to be copyrighted. According to current laws, unless you go on record stating that your work is public domain, it is automatically understood that said property is owned by you and under copyright. Now the fact that he is in Canada might be a problem. However, I'm fairly sure the Canadians have laws similar to our own regarding this so there might very well be avenues of legal recourse you can pursue.

I'd believe that if he was hosting dutch auctions, where masses of the same item is being sold. But instead he's selling only 3, individually. It leads me to think he's iron pressing or silk screening them...

I contacted and reported to Ebay the item numbers, but how the hell are they going to figure out that they're infringing upon my image? It's not like my image will suddenly pop up as highly trended on a google search...

I also sent a message to the auctioneer, asking if he makes the shirt. If he isn't, I'll ask him who is. If he is, I'll just spew some threatening rhetoric... If only he lived in L.A...

Hopefully eBay will do something about this. You've certainly got enough evidence showing that it's yours; for one thing, there's that "making of" video on YouTube that predates this guy's auction.

I had the same issue last year. I took an image from a freebie pics site (something I couldn't replicate myself) only to receive a message from the owner threatening legal action.

But I'd assume that was a rare case - and I wouldn't think of stealing an image to sell it on. But as has been said - you're within your rights to take action.
