Cleopatra 1963, Trek influences??

I am learning about electronic remix culture lately and from what I've read there's no court decision yet on current style of remix being fair use or not. Labels are afraid to sue producers because they might lose and then the barn doors are open.

Arguments in favor of remix where the source material is obviously someone else's (just heard jazz singer Dinah Washington remixed to a "sick beat") is that it is a fairly inexpensive way for the common person to do pro-level art. No need for studios or original songs or skilled instrumentalists.

The argument against is that your art wouldn't exist without my original effort and expense, so pay me somethin'.

One always has to beware of crytpomnesia. It's an insanely easy trap to fall into. I once wrote a scene that had to have two brothers fighting, and later I was re-reading a Buck Godot, Zap Gun for Hire comic and saw a very similar sequence. The trouble was, the idea of these two brothers fighting came out of the culture I'd created for them, but it was similar enough to the comic to make me take pause and rethink the scene because I couldn't be sure that comic hadn't "inspired" the action I'd written.

Remember the "My Sweet Lord" / "He's So Fine" controversy?
Post 51 does.

Remember the "My Sweet Lord" / "He's So Fine" controversy?

I mentioned that in my earlier post; lawsuits such as that one existed for a reason, and whether one acknowledges it or not, the judgement did not say George Harrison was simply "remixing" based on an old song (which was only around 6 years old at the time Harrison "wrote" his version). My Sweet Lord would not exist at all if He's So Fine was not swiped in such a thorough manner.

That'll teach me to skim!

I'm just thinking about what Trek might have been like if that earliest trek movie concept got Cleopatra's budget.
