I am learning about electronic remix culture lately and from what I've read there's no court decision yet on current style of remix being fair use or not. Labels are afraid to sue producers because they might lose and then the barn doors are open.
Arguments in favor of remix where the source material is obviously someone else's (just heard jazz singer Dinah Washington remixed to a "sick beat") is that it is a fairly inexpensive way for the common person to do pro-level art. No need for studios or original songs or skilled instrumentalists.
The argument against is that your art wouldn't exist without my original effort and expense, so pay me somethin'.
