CBS/Paramount sues to stop Axanar

It seems Axanar Productions will be non-profit but the studio won't.

I just think the whole Axanar crew just doesn't grasp that the bear has its limits.

The guidelines say "hands off Trek-reputation-derived money (especially when you pocket it into privately owned assets) and hands off of long format content".

Axanar says

- You haven't said anything about any media besides video/film, so we will take every other content format we can for all we can without any regard to any time or continuity limits.

- You didn't try to shut down the for-profit facility we built with Trek money, so you have no grounds now to object if we raise even more Trek-reputation-derived money and just put it there.

- You only said no crowdfunding for the Axanar film, so if we claim that other hypothetical future projects will share crowdfunding assets we continue to build with ongoing Trek-reputation-derived Kickstarters, the restriction doesn't count.


I think the way in for the studios now is to go after the studio.

They should have swatted it.

The IS KS clearly is described as trading on Trek market value, to Trek fans, with an intent to capture that money into a for profit organization actively looking to make a profit off of the assets the 'donations' buy.

Surely the settlement couldn't have conceded this profit opportunity to team Axanar.

Maybe there is some tacit loss of rights to sue again over Trek fan money put into the studio already; but the new KS could be another round.

Raising money off of Trek for the buildout/operation a for profit asset, and then saying some of its resources will have discounted prices for fan films, is not = 'raising money for a one shot fan film'. It is a funding objective which is outside the guidelines, and does not have to be tolerated.

(Edited) I incorrectly reported the Facebook thread in which Alec Peters revealed his soundstage isn't soundproof had been deleted. In fact, the thread remains intact, and posted in the closed Axanar Donors' Group.

If they got permission to mail, which for donors and their store customers they presumably have, they just have to express the mailing in certain ways - have an opt out link that works, identify where the email came from, etc. If they cross-promote to Propworx customers, then its a problem. Is that what you were noting?....

While technically true, in the end I doubt most Propworx customers would complain about receiving Axanar donation emails unless they had a very strong feeling about Axanar. Collectors probably don't want to bite the hand that feeds them.
 
Update: The Facebook thread in which Peters admits to the lack of soundproofing for his 'professional' studio has been mysteriously deleted from the Axanar Donor Group.

The accumulation of professional mistakes, as noted upthread, is probably going to kill this studio except for bottom-feeding clients squeezing it for giant discounts.

Is it near traffic or other noise sources?

Could be a new product category for the industry: a "Fan Stage".

Maybe shoots that are fully dubbed (oh say like pew pew) might work. I suppose there could be a market for sfx-heavy scenes. Good thing they have all the power needed to run all that customized lighting and robotics and etc..

hmm. Alec, quoted in the article:

"It should be noted that no donor money went to myself in either salary or expense reimbursement. Legitimate business expenses like insurance, meals, travel, auto reimbursement and salary, were all paid for by myself and the others who donated their support and made up the almost $300,000 in additional expenses covered beyond what donors paid for."
Yes, please emphasize to donors that over and above all the money they gave, you and others put in 300k of your own, and EVEN THAT wasn't enough to make a fan film.

Yes, underline it. Offer a story that looks bad to cover up something they know about that looks even worse. In fact, say explicitly to them that they should note that a 'something worse' isn't true, and tell them exactly what that something is, just in case they hadn't heard it yet.

That strategy won't faze donors at all.

And while we're on the subject, it should be noted that Alec never went to any conventions or gaming weekends either. After all, he came back.

And then, this to look forward to:

"We announced a crowdfunding campaign for Industry Studios that was originally planned to coincide with our announcement today, but has been delayed for a bit so we can coordinate better with Kickstarter and plan out our perks."​

Um... perks for Industry Studios that do not tie it in any way to Axanar or Trek? What might those be? Walk-ons in undetermined future fan productions that can't be called Trek either? Weekend construction volunteering gigs for any electricians out there? Services by the studio? A spare piece of soundproofing?

This campaign for a studio built as 100% higher priority than the fan film it was supposed to nurture is gonna be interesting. And I hate to say it, but it might suck in some people who get enthusiastic about the idea of a 'fan studio' without even knowing the history.

How much anyone wanna bet there will be no disclosure (especially in the "Risks" disclosures) of any of the lawsuit prone and never-finish-the-proposal-even-with-way-too-much-money-but-still-spends-it-somehow prone management history?

Isn't it even the slightest bit possible that crowdfunding platforms may want to avoid the blowback of sponsoring the continuation of a bait-and-switch that already used them and drew a lawsuit?

Does anyone really expect Axanar to produce anything of substance? (Controversy doesn't count.) Anything at all? I don't. So just sit back and wait, folks. There's nothing to see here. Literally.
I've given up any hope that anything will be produced at all. I have no dog in this fight, but it frustrates me to see fans get the runaround.
 
Let's see if/how well KS and/or IGG embrace The Fundraiser for the Studio Which We Swear We Built and People are Gonna Use and Make (Us) You Money and is Like Totally Soundproofed (so silly of us to say otherwise) and Up to Fire Code (really, cross our hearts and hope something dies) and There's No Question that We're Allowed to do this Here (even though we just rent the place and who knows if the landlord ever gave permission for these kinds of modifications or the area is zoned for it at all) and There's Air Conditioning (if you visit the diner down the road) and There Are Dumpsters You Can Use (we really have those! Just ask Diana!) and We Are Totally in Cool with the IRS (maybe) and We Would've Made a Movie If It Hadn't Have Been For Those Meddling Studios (oops, wrong franchise) and You Already Gave Us Over a Million and We Could Have Made This If We Had Not Spent Like Drunken Sailors and Instead Bothered to Shop Around Even the Tiniest Bit and Used a Nearby Studio (the place is crawling with them and many of them are far nicer than ours with truly experienced staff) Instead of Trying to Make a Business Off the Backs of Others' IPs (move along, nothing to see here) Oh I'm Bored Now, Let's Go Get Sushi fundraiser.

But I can see where that might run into a slight character limit.
