CBS/Paramount sues to stop Axanar

Like someone on Facebook said, this has to be a move of desperation..........they're in a rush to clean out their warehouse cause they know their asses are cooked.

Its become a source of endless amusement to see how Axanar thinks they can pull one over on the entertainment industry. Like *those* attorneys haven't seen a shady production house before.

Just how do you get a "screen-used tunic" from a production that has never and will never be filmed??
 
One thing I've been thinking about is something others have mentioned here & there - Winston & Strawn's probable long term objective of setting some sort of legal precedent that they could then translate into high-profile business.

That said, I wonder if its possible Ranahan doesn't care so much about LFIM as she does about the legal strategy/gamesmanship that will get her to her goal (i.e she doesn't and won't give a damn about Alec & his shenanigans right up until he/they start sabotaging her strategy)

What about insignias?
Are costumes copyrightable? If not, then how could one sell a license to make official costumes?
While not copyrightable you can seek trademark status, and it's under those auspices that licensees have rights. The present legal case against Axanar, however, is a copyright action, not a trademark one.
 
Would the lawyers be paying any attention to the things that Peters is doing on a day to day basis or is posting online? I've seen some posts about how they are reacting to the stuff Peters is doing and saying, but I was wondering, would they even be aware of what he's doing outside of things they are specifically involved with?

After some of the things I've seen happen in the corporate world and drawing lines between a few indirect points, I'm left to believe W&S involvement is far more nefarious than meets the eye.

They are at least peripherally aware, as a Facebook post ended up in a plaintiff's document (response to the first MtD, IIRC).

I expect nefariousness is in the eye of the beholder.
 
At the rate Peters is going he's running the risk of being sacked by his lawyers. He's clearly not listening to his legal advice by selling these uniforms. Once you have a client who refuses to listen and compounds your ability to act in his best interests it is sensible to come off the court record....well, where I am anyhow.

Peters is "just another prick and [CBS is] a sledgehammer."

(Yes, I know the lyric is "brick." The above usage was intentional.)

This isn't a strategy; it's Peters' strategery. He's literally helping CBS to destroy him.
 
Has anyone stopped to consider Axanar may just be one of J.J. Abrams' marketing gimmicks gone horribly wrong?

Nope. Mainly because the marketing for Axanar was too pretentious and gave away a lot where J.J. Abrams tends to be secretive and whets the appetite of moviegoers (e.g. marketing for the 2009 film and Star Wars Awakens).

Axanar production: "We're doing what Star Trek fans want. We speak for all Trek fans. The JJ Abrams have taken that away with their space battles. Trek is more than space battles!"

*Axanar marketing then focuses elaborate space battles and cameos by established professional actors*
