CBS/Paramount sues to stop Axanar

Given Ares Digital's status as a conduit through which C/P's IP could be/was being infringed have any bearing at all on the merit of any prospective lawsuit by Terry?

I wouldn't think so, actually. If, say, I lent you my car and you damaged it because you were committing a robbery, doesn't mean I couldn't sue you for the damages to the car.

Now, would there be any money to get from the lawsuit?

If Terry isn't careful, and waits too long to sue, he might be at the end of a long line.
 
Wait. So, he's admitting to making Star Trek costumes without a license?
Um. Wouldn't that be a violation of copyright?

WHY--WHEN YOU ARE BEING SUED FOR COPYRIGHT INFRINGEMENT--WOULD YOU CONTINUE TO INFRINGE AND ADMIT IT??!!

He would contend that the Ares tunics are an original design, and that you can't copyright clothing. There's actually some legal ground to stand on there, in this limited instance.
 
This was sent out recently to donors:

"Any donors who wish to receive the uniform perks they have already donated for need to do the following to ensure extremely slow delivery:
1) Write their full name and the address they wish the perks to be shipped too on a small plain notecard.
2) Wrap said note card around a stack of US $100 bills (stack must be no thinner than 1/8th inch)
3) Place note card and stack of bills along with a check or money order made out to Axanar Productions

the amount of $17.01 (for shipping and handling) in a self addressed large box and mail said box to the address listed at the bottom of the first pinned post in the Axanar Donors Facebook page.

We recognize that this might be a minor inconvenience but assure you that it is necessary to overcome the actions of our former technologist Terry Deplorable Slapandtickle and provide the needed information for our new technologist Bill Jesus Moses Buddha Confucius Vishnu Mohammad Watters and the Angels of Mercy that regularly guide his steps.

Please also note that said uniforms will arrive 4-6 weeks prior to Alec's next sci-fi convention and may or may not match the suddenly blurry photographs on our website.

Donors who wish to receive their uniforms in time to immediately hand them to the homeless guy on the street corner so that he can burn them to stay warm during the 2017 holiday season will want to visit our Donor Station where they will also find many wonderful items from the Propworx collection - items that are completely unique and are in no way leftover from a previous auction.

As always - thank you for your support and please, for the love of God - send someone to rescue me!

Like someone on Facebook said, this has to be a move of desperation..........they're in a rush to clean out their warehouse cause they know their asses are cooked.

Either that or a ham-fisted attempt at keeping their victims, sorry, supporters on side with a good-will gesture. Up to a point I would probably accept that; the fact that they're not screen-used. As a loyal supporter I would understand that they can't be screen-used as those bastards at CBS/Paramount have put the kibosh on it.

However, because this is obviously a job-lot of pre-paid for tunics for which they now have no money to complete then the whole strategy comes undone. Much like the tunics will.

But you and I know fine well Facebook is going to be chock full of Axanar supporters wearing their badly sewn tunics with big smiles on their faces and bleeding pin punctured hands doing the Vulcan salute.

Because some people wouldn't say shit if their mouth was full of it.
 
At the rate Peters is going he's running the risk of being sacked by his lawyers. He's clearly not listening to his legal advice by selling these uniforms. Once you have a client who refuses to listen and compounds your ability to act in his best interests it is sensible to come off the court record....well, where I am anyhow.

One thing I've been thinking about is something others have mentioned here & there - Winston & Strawn's probable long term objective of setting some sort of legal precedent that they could then translate into high-profile business.

That said, I wonder if its possible Ranahan doesn't care so much about LFIM as she does about the legal strategy/gamesmanship that will get her to her goal (i.e she doesn't and won't give a damn about Alec & his shenanigans right up until he/they start sabotaging her strategy)

Oh yes, I think that's highly likely. I said it myself when pro bono representation was mooted all those months ago.

I'm running a case through the (UK) Court of Appeal at the moment and doing it for hardly any fees. My sole objective is to get our relatively newly set up firm some recognition in the law reports.The reputation boost can be very helpful. I have a case many years ago that went all the way to the top and it was tremendously good for the firm I worked for at the time.

However, you still have a professional responsibility to both your client and the court. For example, I had to come off the court record earlier this year because a client simply refused to listen to advice and provide adequate instructions. It put me in a position whereby I could not be confident that I was not a party to an attempt to deceive the court or advance a case in ignorance that might harm the client.
