Ah. Well it was the not so oblique referencing the fulfillment person in this production by using a picture of a person with a toy airplane shoved into an orifice .... and that it has a site segment pull down link to AxaMonitor, associating itself to AxaMonitor
 
In my experience the NSFW warning is a good thing to pay attention to, it saves you embarrassment and the energy needed to take offense at objectionable material.

Thanks, it's okay, I'm not embarrassed. And were it not reflecting on the fulfillment person associated with this litigation and AxaMonitor associated with this litigation quite possibly it wouldn't have been more than a blip to me.

according to whois, Terry owns the domain ares.digital. the 'axanar' part is just a subdomain. Technically, he is free to create that.

But 'Ares Digital' might be copyright by Axanar Productions or Alec by virtue of it being a dba they were/are operating. They conceivably could go after the domain with a C&D and file a dispute with ICANN over cybersquatting on brand confusion. Depending on the contents it might also become a target for C&D on defamation if it goes down that path and doesn't stay in satire.

So whatever might be on this domain name, it may have a relatively short shelf life under this name.
 
Terry seems pretty hostile to Axanar at this point. If he has any info that he might have been holding back out of remaining sympathy for the project/Alec, this sort of comment suggests to me he may go ahead and release it.
I see, thankyou. Until all this the only time I heard the word deposition was watching old episodes of Matlock.

I already reported on Axanar's cash problem back in July. A third-hand reference from a phone call, "point blank" or not, isn't enough to justify an article. Moreover, an attorney revealing the cash position of a client to someone threatening legal action against that client seems to me like a potential breach of privilege. So color me skeptical of the claim apart from what I've already reported, which has documentary evidence substantiating it.

And this isn't meant as a knock on Terry, just a reflection that in my experience people often hear what they want to hear and "round up" to the truth, often unconsciously, so it's simply prudent to proceed cautiously without stronger proof.
 
By the way, it did occur to me that Ranahan may have been authorized by Peters to reveal this information to Terry in an attempt to dissuade him from filing suit against Axanar regarding its use of the name Ares Digital, which Terry claims to own. In which case, I think publishing what Terry said would perpetuate the manipulation that may be involved here.

The overly crude tone he's adopted (no matter how funny or justified), fills me with a good deal of doubt as to his credibility & truthfulness. I think he sees the writing on the wall and/or is betting on the courts taking Alec to the cleaners and just wants to press him further into a corner to satiate his own ego.

If it is interesting enough I suppose it could go viral among the Axanar donors who want to see a train wreck (and if a half hour space battle in an hour and a half film is their cup of tea, I guess a lot of them might). Then they might hear ideas that are not Pravda inside the walled garden.

Agree tho, crude destroys credibility quickly.

Hm, the way Alec always talks about "our" Ares Digital, I had assumed he had specified the name to Terry. I will say, the registration of ares.digital online prior to July (which can be seen) gives Terry's name, but Axanar Productions as the company of the contact. This implies the company owned the name, if not the domain, and that Terry was an agent for Axanar Productions in acquiring the name. It looks like someone removed that attribution in July, if I am reading the whois correctly.

As far as trying to dissuade a very pissed off person not to sue because there is no money to be had, where that information is antimatter for the pissed off person to throw on the fire, I'd say that would be a mistake.

Don't get me wrong, anything that paints LFIM + Axanar in a bad light, I generally applaud. In going Terry's route though, not only does personal credibility crumble, but the message (i.e 'Alec is an arrogant, egotistical POS' etc) does as well - or at the very least, it becomes watered down. The longer he chooses to go this route, the more Alec gets built up into a martyr (at least until that incriminating evidence comes out, if at all).

Given Ares Digital's status as a conduit through which C/P's IP could be/was being infringed have any bearing at all on the merit of any prospective lawsuit by Terry?
