CBS/Paramount sues to stop Axanar

Small bit o' news from PACER: Andrew Jick has apparently left Winston & Strawn. He is being replaced on the case with Diana Hughes Leiden.

I do not know where Mr. Jick has gone to; his LinkedIn profile has not yet been updated, but that's not a priority for everyone, of course.

Note: Diana Hughes Leiden does not appear to be any sort of a relation to:

  • protoDiana
  • Ted Hughes
  • Finola Hughes
  • Howard Hughes
  • Johnny Lydon
We are calling Diana Kingsbury "Prime Diana" nowadays. Helps keep all the timelines straight.
 
I think I would enjoy watching that more than Axanar now...

Gabriel Charles Koerner of Trekkies fame has a fun thread up on his Facebook page. Lots of interesting discussion of various issues surrounding the production of Axanar, and some pictures of the partially completed sets. Alec had made a bunch of comments, but deleted them yesterday - typical behavior for him.

*shrug*. I was browsing through his stuff on FB during lunch and I screencapped some interesting remarks. I'm sure I could find more if I wanted to.

Spokesperson Reese asserts this proves Alec is not responsible for the perks delays.

To the contrary. Any CEO with a business commitment is responsible to recognize he won't be able to meet his date, and take necessary steps in a timely manner to remedy the situation, as well as communicate the fix to affected parties.

Allowing this situation to go on for many months and even ignoring statements indicating it wasn't going to get done does NOT constitute exonerating business behavior.
This. SO this! And as this is a professional project as is maintained by the defendant... So Sooo this!

Profile http://www.winston.com/en/who-we-are/attorneys/hughes-diana-l.html shows her to be a specialist in fair use and contention thereby in new media areas. They may be strengthening their bench either in hopes of forcing a better settlement or making sweeping discovery inquiries within which they could go fishing for things they can dispute. In for a penny... or maybe more accurately, bacteria found an opening...

I'm sure this continued W&S agenda must be heartening to Axanar. OTOH, W&S must hope the circus builds so they can get max PR out of any scrap of IP law they can dispute.

I don't see either of those parties aligning their behavior with the interests of fans other than Axalites, though. Everyone else is collateral.

As entertaining as it is at one level, the damage has to stop. Perhaps what would really short circuit all this would be firm evidence, if it exists, that this whole project was turned into a strategy to acquire the studio and a deliberately string out public funding to maximize the funds for the business plan. Any concrete statements to this effect, should they exist, would certainly undo the Axalites support, make a documentary unpalatable, and make the case unpalatable in the press as well.

Am I proposing Terry dump his email backup? No. But if anyone received any such emails, they might be in a position to disclose what they were personally sent, or at least summarize the nature of the discussion. Not sure the law around all this.

Anyone know what their exact argument for fair-use will be? Are they going to argue that just Prelude is fair use due to its documentary-style format, or are they going to say the full-length movie is also somehow fair use? From what I've heard about the leaked scripts, it won't be the same type of "mockumentary" as Prelude was. And even if it is, I don't buy the idea that such a format would be fair use.
 
Ok, so here's a little observation. Alec offered Terry stock in Industry Studios. He didn't say "I can speak to them and see if they can offer you..." or "we discussed it and they are willing to offer you..." . Ergo, Alec is one of the principals of Industry Studios.

Perhaps... but considering the fact that Alec tends to have a hard time keeping straight what he is and what he controls, he could have been blowing smoke up the ol' tailpipe.
